Opening the event the initiators read an address on behalf of Azerbaijani mass media and non-governmental organizations. The address says that the Hungarian media is biased when covering the legal proceedings against Ramil Safarov accused of murder of Armenian officer Gurgen Margaryan. “We ask you to treat the problem more seriously. Presently over 30 000 people of Armenian origin live safely n Azerbaijan,” the statement says. “If you have doubts over the facts mentioned by us, we are ready to organize your arrival in Azerbaijan to see the picture on your own,” the statement authors say. Azeri media and NGO representatives intend to send a video cassette to the Hungarian colleagues showing the events of the alleged «genocide in Khojaly,» of which R. Safarov was a witness. «Thereupon, it is easy to understand R. Safarov's feelings, who lost his property and was many times insulted by Gurgen Margaryan. The judge will have the last word. However, we ask you to be more attentive when writing materials over the incident. The media and NGOs play a large role in forming the public opinion. We believe that you will understand us and will acquaint the Hungarian people with our address,» the statement says. A similar statement was sent on behalf of Azeri media and NGOs to Budapest judge Mr. Andresh Vashkuti. President of ANS group of companies Vahid Mustafayev suggested creation of a Monitoring Center that will engage with the problem. «For example, two or three journalists will follow the materials of Hungarian media over Safarov's case. It is also necessary to finance the trip of our delegation to Budapest. Besides, we should not be ashamed and merely buy strips of Hungarian media, who will publish the information we need,» V. Mustafayev said. It should be noted that during the hearing it turned out that during the events in Khojaly R. Safarov was not in Azerbaijan and thus could not witness the events in Khojaly. Moreover, according to the testimony of Anar Aliyev, another Azeri serviceman taking part in the NATO courses, there were no conflict situations between Armenian and Azeri officers. Thus, statements on «insulting Safarov» are groundless. The next hearing on Safarov's case will be held March 7, 2006. It should be reminded that February 19, 2004 lieutenant of Armenian Armed Forces G. Margaryan sent to Budapest to take part in English language courses within the Partnership for Peace program was brutally hacked by the Azeri officer, who also took the same courses. Safarov is accused on article 116.2 of the Hungarian Criminal Code (murder committed with special cruelty and attempt at life of over one person), which provides for a punishment from 10-15 years of imprisonment to life sentence. ! Officers of the Azeri Embassy in Hungary will take part in the hearing. Hungarian lawyer Klara Fisher will defend Safarov's rights at the hearing. 19 June 2004 asked R. Safarov to present his telephone card. Safarov did not know Hungarian and «did not understand» what they wanted, which poured into an incident. As a result «8 policemen bent him and ties his hands, thus applying force against him.» After that, in spite of Safarov's lawyers' appealing to judicial institutions, the court referred to absence of proof and closed the case. Following that the opposing party filed a suit on the officer resisting to authority representatives, reported APA Azeri agency. As earlier reported by IA Regnum, Armenian MOD representative on the case of Margaryan's murder Hayk Demoyan stated, «This is what Safarov himself said during the third forensic and medical trial, which the defense liked so much, but which was recognized void, «That day my lawyer called me up and I got to know bad news from him and then started kicking the door. When the guard opened the door I poured water on him.» I think you will agree that Hungarian guards could not act in other way in this situation, but apply force against the storming prisoner. I fail to see your logic and Ramil Safarov is lucky Europe does not have the death penalty, but I hope someone kills him in prison, because animals like that do not deserve to live in this world. Progressive party, disputable offer: Urikhanyan lusts for revenge Tigran Urikhanyan, leader of the Progressive Party of Armenia, held a well publicized rally on February 21 at Republic Square where he called for Armenians to take justice in their own hands if a court in Budapest, Hungary, does not sentence Azerbaijani officer Ramil Safarov to life in prison. “You might say these kinds of calls are not human. But if you dream of the future, expectations and hopes were stabbed with an axe 16 times, in that case there would be nothing left but to respond in the same way,” Urikhanyan said. Margaryan was axed to death in his sleep while attending a NATO-sponsored English-language course in Budapest on February 19, 2004. The brutal killing has inflamed already existing ill will between Armenia and Azerbaijan, as the two nations are coming under increased international pressure to resolve their lingering territorial disputes. Safarov, 27, has admitted killing Margaryan, who was 26. But he now recants testimony he gave in the preliminary investigation that the killing was premeditated revenge for the losses Safarov’s family suffered in the Karabakh war. He has told the court that he now feels remorse for the crime. According to Safarov’s defenders, the killing was a result of the emotional trauma Safarov suffers from cruelties he witnessed at the hands of Armenians in the Azeri settlements of Khojalu and Jebrail. “He said he had eyewitnessed how Armenians butchered and raped Azeris,” said Nazeli Vardanyan, state-appointed lawyer for the Margaryan family, “although there were contradictions in his testimony.” Safarov’s defenders are also claiming that the Armenian officers were insulting the Azeris prior to the killing, although witnesses have denied those claims. Despite the emotional tensions in the case, some Armenians have questioned the Progressive Party leader’s call for vigilante justice. In Parliament this week, National Assembly Deputy Hmayak Hovhanisyan spoke against the revenge money. “One mustn’t measure patriotism with money,’’ Hovhanisyan said. “It’s a bombastic declaration, which is, on the contrary, an attempt to smear patriotism. I condemn murder and am sure that the Court will carry out a verdict he (Safarov) deserves.” Publicist and writer Zori Balayan, accused Azeris of fomenting violence, but said Armenians should not resort to reprisals. “We should not get infected by their beastly hatred, we should not repeat their crime,” Balayan said. “Ours is a moral war, an information war to show the world who our neighbors are.” Ishkhan Saghatelyan, chairman of the Armenian Revolutionary Federation Student Union, urged Armenians to wait for the outcome of the Safarov trial and called for an end to hatred. “We demand that the international structures stop the Azerbaijani policy of hatred towards Armenians,” he said. To remind, the results of the third examination were represented at the previous trial. The expert had to represent the difference of the first and the second examinations and give the final evaluation. According to the Court decision the final evaluation of the examination must be given by psychologist-specialists of Debrevitsin University Centre of Examination. To note, earlier the President of the palace of Lawyers’ Union Rouben Sahakyan informed Panorama.am that he had suspicions in concern with the impartiality of the court examination. As he said one mustn’t trust the Judge as there is cause to hesitate at any rate. “And what if the Judge agrees with the position of the experts?” R. Azerbaijani officer Ramil Safarov, who is charged with murder of Armenian officer Gurgen Margarian, was recogniized as sane at the regular court sitting in Budapest, Radio Liberty reported. Lawyer Nazeli Vardanian who defends the interests of the Margarian family told during an interview to Radio Liberty that after hearing the testimonies of two Hungarian witnesses and the conclusion of the fourth expert, the court dismissed all the petitions of Safarov's defence to call new witnesses to court, and based on the first expert's conclusion about Safarov's being sane at the moment of committing the crime, court decided that there is enough information for the final conclusion of the prosecution and defence sides. The prosecution and defence speeches, as well as the final word of the accused will be heard at the next sitting to be held on April 4. The court ruling will be made public on April 13. According to Nazeli Vardanian, since no changes were made in charges brought against the accused during the trial, in accordance with the Criminal Code of Hungary and based on the charges, Ramil Safarov may be sentenced to 8-15 years' or life imprisonment. In his words, the murder is qualified as a purely criminal one in Hungary, without any political implication. «Within past two years the Azeri party constantly tried to politicize the case, trying to document that the Nagorno Karabakh conflict had allegedly served as the cause of the murder. Safarov's lawyer Adil Ismaylov tried to pass some documents to the judge, which were officially returned to him with an accompanying letter that expressed refusal to consider the package during the trial,» Demoyan said. In his words, Turkey is very interested in soonest possible completion of the trial, as Safarov was trained in military camps of Northern Cyprus and Turkey will be exposed to risk if it is known. Meanwhile, Demoyan remarked that Armenian media and individual politicians paid to much attention to Safarov and made a number of irresponsible statements, which hampered Hungary. «For two years we passed the control at the Budapest airport without difficulty, while this time we were searched for arms this time. Ministry of Defense representative Hayk Demoyan and Nazeli Vardanyan, the state-appointed lawyer for the victim’s family, said last week’s decision cleared the way for the emotionally charged case to be brought to an end. “The fact that no extenuating circumstance was left for Ramil Safarov in this last session brings to a confidence that Judge Andras Vashkuti will make a very severe decision,” Demoyan told a news conference on March 14. “The officer of the Azerbaijani army should be condemned as an appalling criminal who is able to kill a sleeping man,” Demoyan said. Lawyers for Safarov will present their final defense arguments early next month before the court in Budapest decides his fate. At a hearing on April 13th, the court is expected to sentence Safarov to either life in prison or a lesser penalty of 10 to 15 years behind bars. Safarov, 27, has admitted killing 26-year-old Lt. Gurgen Margaryan, who was sleeping in his bunk when attacked on February 19, 2004. The two men were participants in a training course offered by NATO’s Partnership for Peace program, which seeks to increase cooperation between former Soviet bloc nations and the western military alliance. http://armenianow.com/images/uploadedimages/ai141301.jpg …The verdict is- mentally competent The Azeri lieutenant has recanted testimony he gave in the preliminary investigation that the killing was premeditated revenge for the losses his family suffered in the Karabakh war. Safarov’s lawyers say the killing was a result of the emotional trauma the young man suffered after witnessing Armenian attacks on the Azeri settlements of Khojalu and Jebrail. The defense is scheduled to wrap up its case on April 4th. Safarov underwent several examinations to determine his emotional state. Finally the court-ordered psychiatric examination determined that he was aware of what he was doing the night he killed Margaryan. According to Vardanyan, two Hungarian witnesses told the court that there was no evidence at the NATO training course of provocation between Azeris and Armenians. The statement says, “the reason is that Armenians have recently declared that they will pay $125 thousand for Safarov’s head. The Karabakh Liberation Organization has also recently appealed to the Hungarian government with a similar request, APA reports. February 19, 2004 lieutenant of the Armed Forces of Armenia Gurgen Margaryan, sent to Budapest to take English courses within the NATO Partnership for Peace Program, was brutally hacked by Azeri officer, who took the same courses. Safarov is indicted in compliance with article 116.2 of the Criminal Code of Hungary (murder, committed with special cruelty, and attempt at lives of over one person), which provides for punishment varying from imprisonment of 10-15 years to life sentence. MosJan Posted April 5, 2006 Report Share Posted April 5, 2006 30 YEARS IMPRISONMENT FOR RAMIL SAFAROV * Yesterday the Budapest court continued the trial over Azerbaijani serviceman Ramil Safarov charged with a murder of Armenian officer Gurgen Margarian. The murderer was allowed to have a final word. Despite the efforts of Safarov’s lawyer, the judge said that the defendant’s guilt is already established and that the latter was sane while committing the crime.
