By launching the terror attack in Nagorno Karabakh on March 5 Azerbaijan sought to derail the negotiations, make fabricated accusations on shipments of arms from Armenia to Nagorno Karabakh and create new fake narratives and information flows in order to divert attention from its non-compliance with the International Court of Justice ruling, PM Nikol Pashinyan said on Thursday. Speaking at the Cabinet meeting, PM Pashinyan said the situation has escalated in Nagorno Karabakh in conditions of the blockade of Lachin Corridor.He said that on March 5, an Azerbaijani military unit ambushed a police vehicle of Nagorno Karabakh which was en route from Nagorno Karabakh’s Stepanakert to Nagorno Karabakh’s Hin Shen and Mets Shen, killing three police officers and wounding one. Pashinyan extended condolences to the families of the officers and the entire police force of Nagorno Karabakh, and noted that all three fallen officers were born in Nagorno Karabakh. “This fact is especially important on the background of the Azerbaijani President’s remarks made during the Munich Security Conference on February 18, 2023, where he accepted that there is an international agreement whereby they must discuss with the representatives of the Armenians of Nagorno Karabakh their rights and security. However, the Azerbaijani President said that they were going to have these discussions with the people who were born and have lived in Nagorno Karabakh. On March 1, the first meeting between the representatives of Nagorno Karabakh and Azerbaijan took place in the headquarters of the Russian peacekeeping contingent in Nagorno Karabakh, and only four days later Azerbaijan launched the abovementioned provocation, which is difficult to be described anything other than terrorism. This act of terrorism left three citizens who were born in Nagorno Karabakh and had 1, 2 and 3 children there dead,” Pashinyan said.The PM outlined Azerbaijan’s goals in the March 5 attack. “First goal was to derail future negotiations with representatives of Nagorno Karabakh and create the necessary background for a new military provocation. In this regard I have to stress that the Foreign Ministry of Nagorno Karabakh released a statement yesterday expressing readiness to continue dialogue with Azerbaijan. This is an extremely important statement. I think it is necessary to create reliable international mechanisms in order for an uninterrupted and institutional Baku-Stepanakert conversation to take place, and this could become an effective guarantee for the implementation of the abovementioned international obligation. The next goal of the March 5 provocation was to create fake evidence falsely accusing Armenia in shipping arms to Nagorno Karabakh. This topic is important for Azerbaijan especially after the February 22 ruling by the International Court of Justice, when the court unequivocally rejected Azerbaijan’s request whereby Azerbaijan was accusing Armenia in planting landmines. The groundless accusations on planting landmines made against Armenia in several international platforms collapsed with this rejection. And now Azerbaijan attempted to misrepresent the March 5 incident as a proof on arms shipments from Armenia to Nagorno Karabakh, which failed for two reasons. First of all, the police vehicle was not en route to Stepanakert, but on the contrary it was en route from Stepanakert, and secondly the Azerbaijani ambush and the course of travel of the police vehicle was caught on Nagorno Karabakh police surveillance cameras, which made it obvious that the police car did not contain anything else other than documents and sidearms. Azerbaijan’s next goal was the following. To develop new narratives and information flows with the bloody terrorism to conceal an important fact, that Azerbaijan is explicitly not fulfilling the ruling of the highest court in the world, the International Court of Justice, on opening the Lachin Corridor,” Pashinyan said.The United Nations’ highest court – the International Court of Justice (ICJ) - ordered Azerbaijan on February 22 to “take all steps at its disposal” to ensure unimpeded movement of persons, vehicles and cargo along the Lachin Corridor in both directions. And this constitutes an illegal and explicit encroachment against the sovereign territory of Armenia, which contradicts the agreements and statements made in Prague and Sochi. This means that Azerbaijan has launched a new phase of aggressive policy.”Pashinyan noted that very often the forcibly displaced people of Hadrut are protesting outside the government headquarters in Yerevan. “And they are very right to do so, because, for example, one of the terms of the trilateral statement is about the return of internally displaced persons and refugees to Nagorno Karabakh and adjacent regions under the auspices of the UN High Commissioner for Refugees. So far no one has offered the people of Hadrut to return to their homes, and this is a gross violation of the trilateral statement by Azerbaijan. You know about the deportations of Armenians in Baku, Sumgait, Kirovabad, Shahumyan, Getashen, and the Armenian government, we, have never obstructed them from pursuing their rights, because this is about hundreds of thousands of people. Neither have we encouraged them to do so, perhaps that was our mistake, but we haven’t obstructed them either,” Pashinyan said. PM Pashinyan said there’ve been no cases of forced displacements of Azerbaijanis from Armenia. “We have documents preserved in our archives showing that the Soviet Armenian authorities paid major compensations to the Azerbaijanis, which means that basically they themselves decided to leave, also due to the general geopolitical situation, but there’ve been no massacres of Azerbaijanis in Armenia. Whereas in Baku and Sumgait there were massacres of Armenians, you know about Shahumyan region. He also posed for a photo at the Lachin Corridor, the road connecting Armenia to Nagorno-Karabakh that has been blocked by Azerbaijan for more than three months as Baku tries to strong-arm Armenia into signing a comprehensive peace agreement.“The EU must push Azerbaijan to lift the blockade,” he wrote in a tweet. “If not, we risk a humanitarian catastrophe.” While in Yerevan he also met with journalists and laid out a vision for the resolution of the status of Nagorno-Karabakh, the Armenian-populated territory in Azerbaijan that has been the core of the decades-long conflict between the two sides.He envisaged Karabakh as part of Azerbaijan but with a “special status” protected by an armed international peacekeeping mission with a “robust mandate,” according to an account of the meeting by news website CivilNet. The territory would also be surrounded by a demilitarized zone. Ideally, he said, the peacekeeping mission would be mandated by the United Nations with Russian consent and with American participation.“With all respect for the European Union, when it comes to hard security, there’s only one power on Earth we can trust, and that is the United States,” he said.He also proposed the European Union providing military aid to Armenia to buy Western weapons.“The European Union has a special fund called the European Peace Facility, which primarily until now has been used for Ukraine for many good reasons. Below is the official transcript of Várhelyi’s speech. “Let me thank the Rapporteur, Mr [Andrej] Kovatchev, and all Members who have contributed to the report on EU-Armenia relations that we are discussing today. Your report provides a good overview of the challenges the country faces. Armenia is a country that has suffered a double crisis – the 2020 war and the Covid pandemic. Moreover, following Russia’s invasion of Ukraine, Armenia finds itself in a difficult position, having to rely for its security on a country that is carrying out an unprovoked aggression against its neighbour. In this context, Armenia is looking toward the European Union as a fundamental partner. Given steady progress on reforms in democracy, fundamental freedoms, rule of law and the fight against corruption, Armenia deserves our full support. Our Comprehensive and Enhanced Partnership Agreement is the blueprint for Armenia’s domestic reforms agenda. It has now been fully in force for over two years. The Economic and Investment Plan has the potential to mobilise over €2.6 billion in public and private investments, and it is already delivering in Armenia through developing green connectivity, energy efficiency and as well as supporting SMEs and supporting socio-economic development. Of course, as your report rightly points out, much still needs to be done, when it comes to the functioning of the justice sector, fight against discrimination, gender equality, but also the protection of vulnerable groups, and to tackle foreign disinformation. We have an in-depth regular dialogue with Armenian authorities on all these issues. The report calls to further enhance EU-Armenia economic and trade relations. The EU-Armenia but also Armenia-Russia trade flows have increased several folds since the EU imposed additional sanctions on Russia. The European Union is also actively involved in facilitating dialogue between Armenia and Azerbaijan. In Talish, as well as in other regions depopulated as a result of the 44-day war, Azerbaijan is openly implementing resettlement programs in an attempt to eliminate the Armenian trace from the territories of Nagorno-Karabakh that have passed under its control. At the beginning of the 90s, Shahumyan region, Getashen sub-region, and other settlements with a large Armenian population also suffered a similar fate.The above-mentioned actions of Azerbaijan are in direct contradiction to point 7 of the trilateral declaration of November 9, 2020, according to which internally displaced persons and refugees return to the Nagorno-Karabakh territory and adjacent regions under the supervision of the United Nations High Commissioner for Refugees. The leaders of Armenia and Azerbaijan adopted statements on October 6, 2022 in Prague and on October 31 in Sochi, according to which Armenia and Azerbaijan recognize each other's territorial integrity and sovereignty based on the UN Charter and the Alma-Ata Declaration of 1991, and the delimitation process between the two countries should take place exclusively on this basis. Despite this, on March 18, the president of Azerbaijan again announced that the border delimitation should take place under the conditions set by Azerbaijan and has been continuously talking about some kind of historical maps for a long time.Azerbaijan not only keeps under occupation the sovereign territories of the Republic of Armenia illegally seized on May 12 and November 17, 2021, and September 2022, but also introduced the so-called "Western Azerbaijan" discourse and declares practically the entire territory of the Republic of Armenia an Azerbaijani territory.This is an open _expression_ of aspirations towards practically the entire sovereign territory of the Republic of Armenia. Armenia is “working” in the direction of raising the issue of Azerbaijan’s non-compliance with the world court order on unblocking the Lachin Corridor at the UN Security Council, the Representative of Armenia on International Legal Matters Yeghishe Kirakosyan told lawmakers Monday. The United Nations’ highest court – the International Court of Justice (ICJ) - ordered Azerbaijan on February 22 to “take all steps at its disposal” to ensure unimpeded movement of persons, vehicles and cargo along the Lachin Corridor in both directions. The Lachin Corridor has been blocked by Azerbaijan since 12 December 2022. Kirakosyan was asked to comment on the matter by Hayastan faction Secretary Artsvik Minasyan at the parliamentary committee on state-legal affairs hearings. Minasyan asked Kiraskoyan whether or not it’s possible for the UN Security Council to consider applying the sanctions under chapter 7 of the UN Charter. Kirakosyan reiterated that the ICJ ruling is binding and Azerbaijan must comply with it. “Unfortunately we are facing the reality that Azerbaijan is simply ignoring the ruling, furthermore not only is it ignoring it but it is trying to distort the content of the ruling on the highest official level up to the lowest official level. This was recently seen in the Azerbaijani Foreign Minister’s letter addressed to the UN Secretary General, to which our minister’s letter has been submitted as a response,” he said.Kirakosyan said that article 94 of the UN Charter provides for a certain narrow description pertaining to the rulings. But attempts in the past to bring rulings on provisional measures before the UN Security Council have failed. The cases related to a permanent member, who exercised its right to veto and the issue didn’t make it to final debates. “But in our case I think we should work in that direction. I know that our colleagues at the foreign ministry are working in that direction. It is highly important for the matter to enter the agenda at the UN Security Council. And we must maximally utilize all diplomatic channels to ensure a favorable discussion of the issue,” Kirakosyan said.Taking the issue to the UNSC has two perspectives, he added. First is the formal point of view, there’s article 94 of the charter which gives such an authority to the Security Council. The second logic is chapter 7 of the UN Charter – its mandate for ensuring international peace and security.“The idea is that the non-fulfillment of this ruling creates risks for international peace and security. So we have the chance to raise this issue at the Security Council at least under two logics. Since December 12, 2022, the Lachin corridor, which runs through the Lachin district of Azerbaijan to link Armenia with the Nagorno-Karabakh enclave, has been blocked by a group of people from Azerbaijan described by Baku as environmental activists protesting alleged Armenian illegal mining in the area. Armenian Prime Minister Nikol Pashinyan has repeatedly said that the corridor's blockade violates the ceasefire declaration brokered by Russia between Armenia and Azerbaijan in 2020. The document delegated control of the Lachin corridor to Russian peacekeepers deployed in Nagorno-Karabakh. Azerbaijan marked the 100th day of its blockade of Lachin Corridor by cutting off the gas supply to Nagorno Karabakh, Prime Minister Nikol Pashinyan said at the Cabinet meeting. “This happened after the Azerbaijani leader’s speech – which can’t be described anything else than aggressive - in the village of Talish in Nagorno Karabakh, which has been subjected to ethnic cleansing. What happened in Talish village is a substantial, fundamental proof of Azerbaijan’s policy of ethnic cleansing and genocide. In this village – de-populated from Armenians as a result of the 44-Day War, Azerbaijan is demolishing the homes belonging to Armenians by their right to property and is instead building homes intended for Azerbaijanis. What we’ve been alarming about for so long is now reality,” Pashinyan said.The PM said that by destroying the Armenians’ property in Talish, removing Armenian inscriptions from ancient Armenian monuments, Azerbaijan is showing its model of integration or guarantee of rights and security of Armenians in Nagorno Karabakh. “These actions are illegal and are explicitly contradicting clause 7 of the 9 November 2020 trilateral statement, which says that internally displaced persons and refugees shall return to the territory of Nagorno-Karabakh and adjacent areas under the supervision of the United Nations High Commissioner for Refugees.
