MosJan Posted February 23, 2007 Report Share Posted February 23, 2007 Azeri Jailed For Life In Hungary For Killing Armenian Officer AFP, AP, RFE/RL An appeals court in Budapest upheld a life sentence on Thursday against an Azerbaijani military officer who brutally murdered an Armenian lieutenant during a NATO training course in Hungary in 2004. "The appellate court upheld the life sentence handed down by the first instance [in April last year]," court spokesman Gyorgy Felkai told AFP. Ramil Safarov, an Azerbaijani army lieutenant, used an axe to hack Armenian lieutenant Gurgen Markarian to death in his sleep in the dormitories of a NATO training center in Budapest in 2004. The two officers were enrolled in an English-language course in the Hungarian capital as part of the North Atlantic Treaty Organization’s Partnership for Peace program, of which both Armenia and Azerbaijan are members. Safarov was also found guilty of planning the murder of another Armenian, which he did not carry out. He will be eligible for parole in 30 years. On Thursday, Safarov denied that he had intended to kill anyone, while his lawyer, Gyorgy Magyar, cited some experts' opinions which declared Safarov mentally unstable. Other experts, however, had said Safarov was fit to stand trial. He earlier said ethnic conflicts between Azerbaijan and Armenia were at the root of his actions. The appeals court ruling was welcomed by both Hungarian prosecutors and Nazeli Vartanian, an Armenian lawyer representing the slain officer’s family. “Hungarian courts have investigated all circumstances of the case and have properly appraised the Azerbaijani officer’s actions,” Vartanian told RFE/RL from Budapest. “We warned [the appeals court] that if the first instance verdict is softened, that will create a worldwide precedent and potentially lead to ethnically motivated killings of other Armenians,” she said. Many in Armenia had attributed Markarian’s murder to "anti-Armenian hysteria" fanned by the Baku government, while Azerbaijani officials countered that the killer was himself a refugee from the Nagorno-Karabakh conflict who had painful memories of the 1991-1992 with the Armenians. The April 13, 2006 sentence of Budapest first instance court on case of RA Armed Forces Officer Gurgen Margarian's murder has come into force from February 22. According to the sentence, the murderer sentenced to life imprisonment, Azerbaijani Officer Ramil Safarov who was at Budapest investigation isolator should be moved to a reformatory of strict regime. Lawyer Nazeli Vardanian representing the interests of the aggrieved party reported this at the February 28 press conference. She informed the press conference that the complaint of R. Safarov's Hungarian defender Madyar Dorji was heard at Budapest Appeal Court on February 22. According to the complaint, though the first instance court examined the case very thoroughly, nevertheless, many violations were committed: four expertises were made, but when passing the sentence the court took as a basis only the defender's first testimony when the Azerbaijani Officer confessed that this was an aforethought murder, that unless he killed the Armenian officer at that moment, the murder would be committed at another place. R. Safarov had also said that he had become a serviceman in order to exterminate all Armenians of the world. M. Dorji declared at the court that his defendant gave the first evidence in Russian without lawyer's presence and did not understand what he was saying. At the same time, he said that Hungarians cannot understand why R. Safarov killed the Armenian Officer and why this is qualified in a different way in Azerbaijan and "to kill an Armenian is not considered as a crime there." Prosecutor Edit Bagi in his charge qualified the murder as a cruel, inhuman murder with many aggravating circumstances. "For us, it is very important to estimate the murder as a fact and not to assess to what culture R. Safarov belongs," the Prosecutor said. In the Prosecutor's words, R. Safarov was away from Azerbaijan in the years of war, he did not witness the war and none of his relatives perished in that war. Therefore, as the Hungarian Prosecutor said, the defendant could not suffer and get into stress when seeing an Armenian. In her speech made at the sitting Hungarian lawyer Gabriela Gaspar representing the interests of the aggrieved party said that R. Safarov had committed this murder for being heroized. In her words, the same is noticed in Turkey when they tried to heroize the criminal having committed the murder of Armenian journalist in Istanbul. "The strictest punishment should be kept to put an end to manifestations of genocide, for people not to be killed for their national belonging," G. Gaspar said. In N. Vardanian's words, "the Azerbaijanis have an opportunity to apply to Strasbourg court, which will be only favorable for us." "So, Azerbaijanis will show their cultural peculiarities in the center of Europe, that is, a murder committed on ethnic ground is not a crime," she said. In her words, the documents are ready but taking into consideration that the civil case process is complicated in Hungary more document are needed as well as expenditures must be justified. Safarov’s family representative Ikram Shirinov informed that lawyer Clara Fischer is going to attend the convict in prison. The decision by the Court of Appeal has not been submitted to the lawyers yet. Upon receipt Safarov’s lawyers are going to organize a cassation complaint to the Hungarian Supreme Court. I agree that you cannot judge a whole nation from what a single person did, but the Azeri government hailed the murder, declaring him to be the man of the year, and encouraged the Azeri mothers to name their sons after him. "Azeri Press" agency informed that the lawyers decided to leave the appeal to the court for autumn session, as the Budapest based courts are closing for summer vacations. The military procurator of Azerbaijan Khanlar Veliyev visited Budapest and saw the Azerbaijani officer Ramil Safarov, who is sentenced to life imprisonment for the murder of the Armenian officer Gurgen Margarian. According to Day.az agency the military procurator announced that the physical and moral state of Safarov is satisfactory. He also hoped that they would take Safarov to Azerbaijan. Khanlar Veliyev informed that they would appeal against the February 22, 2007 verdict of Budapest Appeal Court about leaving the life imprisonment decision unchangeable in autumn, as there is no time limit for the appeal in Hungarian Court. An appeal on “Safarov’s alleged disobedience to the warders” will be also considered, he added. Besides, Mr Shirinov informed that lawyer Elmar Kerimov and another lawyer, whose name is not announced, as the contract hasn’t been concluded with him yet, are dealing with the Safarov case, Day.az reported quoting Lider TV channel. February 19, 2004 Armenian Armed Forces officer Gurgen Margaryan, who was taking an English language course in Budapest within Partnership for Peace NATO program, was brutally axed asleep by his Azeri fellow Ramil Safarov. The Hungarian court sentenced Safarov to life imprisonment without a right for pardon during the initial 30 years. In November 2006 the warders brought an action against Safarov. A court of first instance gave Safarov an 8-month sentence for disobedience to authorities. On February 19, 2004, the prison guards told Safarov to give his phone card.
