<h1 class="big center">“NAGORNO-KARABAKH WILL NOT BE LEFT OUT”</h1>
  • “I can only make a positive assessment of the Moscow trilateral declaration regarding the Karabakh conflict resolution. I don't share the prevalent belief that Karabakh is left out of the negotiation process,” the head of the Armenian delegation to the PACE and Chairman of the NA Standing Committee on State and Legal Affair, Davit Harutiunyan, said to A1+ on November 5.

    “Political negotiations are impossible without Karabakh’s engagement in the talks. I find the declaration an important achievement. After the Ossetian events everyone realised that the war is not the right solution to the conflict settlement. The war even leads the issue to a deadlock where it is far more difficult to find a way out. I think that the Ossetian war taught everyone a good lesson. The declaration evidences that we are stepping a rational phase where the sides are ready to cede and benefit. There are neither winners nor losers in the process of negotiations. The settlement of the Karabakh conflict is excluded without Karabakh’s involvement.

    Today Davit Harutiunyan also spoke about the implementation of PACE Resolutions 1609 and 1620 and PACE’s demand to free people detained for their political views, in particular those imprisoned on the basis of policemen’s evidence.

    “I think the best way to solve the issue of people arrested or imprisoned after the March 1 events is amnesty,” he said. In reply to the question why Serzh Sargsyan hasn’t granted amnesty yet, Davit Harutiunyan said, “It is within the authorities of the president, and I do not know the reasons.”

    “All detainees who have not pleaded guilty though their verdicts have been announced are also eligible for amnesty. And all those who have not been convicted yet may reject general pardon and have their case go for trial because they are sure to be acquitted. If nevertheless the court does not acquit them, they will be pardoned.

    Saying that the best solution is amnesty, Davit Harutiunyan also noted that there is time for other solutions as well. When asked to detail those solutions, Harutiunyan said pardon could be a solution or the court of cassation which sets the rules of the game regarding the application of the law may decide in which case the testimony of a policeman is acceptable and in which case it is not. If the court doesn’t justify the arrestee it doesn’t mean he cannot be pardoned.

    Davit Harutiunyan noted that Armenian has received recommendations from the PACE which can be either accepted or denied but at present they don’t think it expedient to deny them.

<h1 class="big center">THE MAINDORF DECLARATION</h1>
  • On November 2, at the Maindorf Castle in Moscow Armenian and Azerbaijani Presidents signed a declaration under the patronage of the Russian President Dmitry Medvedev, which is the first document signed by the two parties after the ceasefire agreement in 1994. In this sense, the document is historical, as the official Moscow seems to do the impossible thing - it persuaded the two countries' presidents to sign the same document simultaneously. However, more important is what the parties gain from signing the declaration.

    We would like to present the main provisions of the declaration that are of great importance and can influence the developments of .

    According to the first clause of the document, the parties "will facilitate the improvement of the situation in the South Caucasus and establishment of stability and security in the region through a political settlement of the conflict based on the principles and norms of international law and the decisions and documents adopted in this framework to create favorable conditions for economic development and comprehensive cooperation in the region". In other words, the parties exclude military resolution of the issue, at least in coming years, and the negotiation process will continue within the principles of the international law, or, correctly, in combination with it. Of course, it doesn't mean that Aliyev will stop his war-like announcements, but they will not be as sharp as before.

    According to the second clause (the parties "reinstate the importance of the mediating efforts of the OSCE Minsk Group Co-Chairs, taking into consideration their meeting with the parties on November 29, 2007 and the future discussions held for the purpose of working out the main principles of political settlement"), the Madrid principles will be the basis for the future discussions, and new principles will not be worked out, at least in the nearest future.

    The third clause (the parties "agree that the peaceful resolution should be accompanied by judicially biding international guarantees in all aspects and stages of settlement) is probably the sincerest clause of the document, as, according to it, the parties cannot act without international countries' consent, for example, they cannot transfer the issue to the UN, and they have to take into consideration the viewpoints of the mediator countries in the whole process of negotiations; it means that their mediation will continue to be active.

    The fourth clause mentions that "the Presidents of Armenia and Azerbaijan agreed to continue the efforts for the political settlement of the conflict and instructed the Ministers of Foreign Affairs to take more active steps in that direction through cooperation with the OSCE Minsk Group Co-chairs". This clause assures that only Russia, USA and France continue to be the mediators in the negotiation process of the conflict settlement, and Turkish and Iranian desire to have their place in the mediator processes is declined from the very outset.

    The last clause of the declaration (the parties "emphasize the importance of creating conditions that will contribute to the reinforcement of trust within the framework of the efforts targeted at the settlement of the conflict") has a declarative nature to conclude the document competently.

    The main question to be answered is "Why was the signing of the declaration necessary?" It was necessary for the Co-chair countries that followed unwillingly other countries' attempts to be involved in the regional developments. It was also necessary for Russia to affirm once more that the most important place for the resolution of the issue is not Washington or Paris but Moscow. It means that Russia strengthening its positions in the South Caucasus needed one more announcement of its reinforcement and the Maindorf declaration was a brilliant PR action for it, especially against the background of the Georgian conflict.

Նոյեմբերի 2-ին Մոսկվայում Հայաստանի եւ Ադրբեջանի նախագահների միջեւ կայացած բանակցությունները ԼՂ հակամարտության կարգավորման հարցի շուրջ պատմության մեջ կմտնեն նրանով, որ 1994 թ. հրադադարի մասին պայմանագրի ստորագրումից հետո երկու երկրների նախագահները առաջին անգամ ստորագրում են հակամարտության կարգավորմանը վերաբերող փաստաթուղթ։ տպել

Հռչակագրի ֆորմատով այս փաստաթղթի առանձնահատկությունն այն է, սակայն, որ այն ստորագրվեց ոչ միայն Հայաստանի եւ Ադրբեջանի նախագահներ Սերժ Սարգսյանի եւ Իլհամ Ալիեւի, այլեւ ՌԴ նախագահ Դմիտրի Մեդվեդեւի կողմից։ Իսկ դա նշանակում է, որ հռչակագրի ստորագրումը բացառապես Մոսկվայի ճնշման արդյունք էր, որի միակ նպատակը հակամարտության կարգավորման բանակցային գործընթացի նկատմամբ Ռուսաստանի տիրապետող, թելադրող դիրքն ամրագրելն էր։ Այսպիսով, Ռուսաստանը վերահաստատեց Ղարաբաղյան հակամարտության գործոնի միջոցով Հարավային Կովկասում լիարժեք մասնակցություն ունենալու իր վճռականությունը։ Հիշեցնենք, որ մինչ այս ԵԱՀԿ Մինսկի խմբի անդամ մյուս երկրների նախագահների նախաձեռնությամբ թե՛ Ֆրանսիայում, եւ թե՛ ԱՄՆ-ում կազմակերպվել են նման հանդիպումներ։ Սակայն ո՛չ Փարիզի, եւ ո՛չ էլ Քի Ուեսթի բանակցություններից հետո որեւէ փաստաթուղթ բանակցող կողմերը չէին ստորագրել։

Որ այս փաստաթղթի ստորագրումը առաջին հերթին եւ հիմնականում անհրաժեշտ էր հենց Մոսկվային, ցույց է տալիս նաեւ հինգ կետից բաղկացած հռչակագրի բուն բովանդակությունը, որը որեւէ նոր իրողության, բանակցային գործընթացում ինչ-որ առաջընթաց ներկայացնելու փոխարեն ընդամենը իրերի ներկայիս դրության ֆիքսումն էր, եւ բացի մեկ կետից, մեծ հաշվով, էական ոչինչ չի ավելացնում հակամարտության կարգավորման գործընթացին։ Այսպիսի բովանդակությունը նաեւ ցույց է տալիս, որ մերձմոսկովյան Մայնդորֆ պալատում կայացած երկարատեւ բանակցություններն, ըստ էության, անցել են անարդյունավետ։

Սակայն, անկախ դրանից՝ թեկուզ զուտ իրերի դրությունը ֆիքսելու դեպքում հռչակագիրը նաեւ ձեւակերպումների, արտահայտությունների, մոտեցումների յուրահատուկ սինթեզ է, որոնք ցույց են տալիս, թե ի՞նչ իրավիճակ է ընդհանրապես բանակցային գործընթացում, եւ ինչպիսինն են թեկուզ ոչ այնքան շոշափելի միտումները։ Իսկ այս տեսակետից հռչակագիրն իր մեջ կրում է հայկական կողմի համար թե՛ դրական, եւ թե՛ բացասական տարրեր։


Դրական կողմերը
1. Փաստաթուղթը չի ամրագրում տարածքային ամբողջականության սկզբունքի գերակայությունը միջազգային մյուս նորմերի նկատմամբ, ինչի միտումներն ակնհայտ էին հակամարտության կարգավորման խնդրում ուղղակի կամ անուղղակի ներգրավված թե՛ ամերիկյան, եւ թե՛ վերջին շրջանում ռուսաստանյան բարձրաստիճան պաշտոնյաների հրապարակային ելույթներում, խոսքերում։ Հռչակագրի առաջին կետում նշվում է, որ նախագահները «հայտարարում են, որ նպաստելու են Հարավային Կովկասում իրադրության առողջացմանը եւ ապահովելու են միջազգային իրավունքի սկզբունքների եւ նորմերի եւ դրանց շրջանակներում ընդունված որոշումների եւ փաստաթղթերի հիման վրա Լեռնային Ղարաբաղի հակամարտության քաղաքական կարգավորման միջոցով տարածաշրջանում կայունության եւ անվտանգության հաստատմանը»։

2. Հռչակագրի առանցքային հատվածը, ըստ էության, երկրորդ կետն է, որն ամրագրում է. «Նախագահները «հաստատում են ԵԱՀԿ Մինսկի խմբի միջնորդական ջաքները՝ հաշվի առնելով 2007 թ. նոյեմբերի 29-ին Մադրիդում կողմերի հետ ունեցած հանդիպումները եւ դրան հաջորդած բանավեճերը՝ ուղղված քաղաքական կարգավորման հիմնարար սկզբունքների հետագա մշակմանը»։

Մինսկի խմբի դերակատարությունը շեշտվում է նաեւ չորրորդ կետում, որտեղ նշվում է, թե Հայաստանի եւ Ադրբեջանի նախագահները պայմանավորվում են շարունակել հակամարտության քաղաքական կարգավորմանն ուղղված ջանքերը եւ իրենց արտգործնախարարներին հանձնարարում են ակտիվացնել քայլերը բանակցային գործընթացում՝ «ԵԱՀԿ Մինսկի խմբի հետ համագործակցելով»։

Այսինքն` այս հռչակագրով վերահաստատվում է հակամարտությունը միայն ԵԱՀԿ Մինսկի խմբի շրջանակներում կարգավորելու սկզբունքը, եւ միջնորդների ֆորմատը փոփոխելու բոլոր նախաձեռնությունները, փորձերը որեւէ արդյունք չեն կարող ունենալ։

Բացի դրանից, Ադրբեջանը հաստատում է, որ չի շեղվելու մադրիդյան սկզբունքներից, ինչի փորձերը միշտ էլ եղել են այն դեպքում, երբ հայկական կողմը մեկ անգամ չէ, որ իր համաձայնությունը տվել է հենց մադրիդյան սկզբունքների շրջանակներում շարունակել բանակցությունները։ Այլ հարց է, որ այդքան էլ հստակ չէ եւ Մայնդորֆյան հռչակագրից էլ բացարձակ չի երեւում, թե ինչ են իրենցից ներկայացնում այդ մադրիդյան սկզբունքները։ Այնուամենայնիվ, ինչ-որ պլատֆորմի վրա բանակցությունները շարունակելու առումով, փաստորեն, երկու նախագահներն էլ պատրաստակամություն են հայտնում։

3. Ամրագրվում է հակամարտությունը խաղաղ ճանապարհով կարգավորելու կարեւորությունը։ Հռչակագրի երրորդ կետն ասում է. «Նախագահները «համաձայնում են, որ խաղաղ կարգավորմանը հասնելը պետք է ուղեկցվի դրա բոլոր ասպեկտների եւ էտապների՝ իրավաբանորեն պարտավորեցնող միջազգային երաշխիքների ապահովմամբ»։

4. Բանակցող նախագահները նաեւ կարեւորել են «կարգավորման համատեքստում փոխվստահության ամրապնդմանն» ուղղված պայմանների ստեղծման նպատակով միջոցների ձեռնարկման հնարավորությունների ընդլայնումը։ Սրանից կարելի է ենթադրել, որ Ադրբեջանում պետք է որ վերանայվի հակահայկական քարոզչություն տանելու քաղաքականությունը։ Սակայն պետք է նկատել, որ հռչակագրի այս՝ հինգերորդ կետը պարզ դեկլարատիվ բնույթ ունի, որովհետեւ ոչ միայն այդ միջոցների ձեռնարկման նկատմամբ վերահսկողություն սահմանելու խնդիր չի դրվում, այլեւ երկրների հայեցողությանն է թողնվում խնդրի լուծումը։


Բացասական կողմերը
1. Ամենակարեւոր բացասական կողմն այն է, որ, փաստորեն, խոսվում է միայն հակամարտության կարգավորման քաղաքական բաղադրիչի մասին։ «Քաղաքական կարգավորում» արտահայտությանը հռչակագրում կարելի է հանդիպել չորս անգամ, որոնցից երեքը՝ բուն կետերում։

Այսինքն` հակամարտության իրավական, պատմական կողմը, որտեղ են հատկապես եղել հայկական կողմի հիմնական փաստարկումները, այլեւս անտեսվում են։ Դրանից բխում է շատ ավելի վտանգավոր մի իրողություն. ԼՂ-ի՝ Ադրբեջանից առանձնանալու եւ անկախ պետություն դառնալու հանրաքվեն, որպես իրավական հզոր գործիք, փաստարկ, կորցնում է իր ուժը։

Հասկանալի է, թե դա ինչի համար է արվում. ըստ էության, միայն նախկին հանրաքվեի արդյունքները «ջրելով» կարելի է խոսել ապագա, առայժմ, մեղմ ասած, շատ անորոշ ինչ-որ հանրաքվեի կամ պլեբեսցիտի մասին։ Հակառակ դեպքում կարող է առաջանալ իրավական կազուս։ Եվ ահա Մոսկվայում, ըստ էության, այս թնջուկը լուծելու նախադրյալներն են դրվում։ Ի դեպ, սա միակ շոշափելի արդյունքն է, որ արտահայտված է փաստաթղթում, եւ որը կարող է էապես անդրադառնալ կարգավորման սկզբունքների մշակման վրա։

2. Հռչակագրի երկրորդ կետն ունի մի շատ նուրբ շեշտադրում։ Այն խոսում է կարգավորման ասպեկտների եւ էտապների մասին, սակայն ոչինչ չկա այն մասին, թե արդյո՞ք այդ «ասպեկտները եւ էտապները» որոշվելու են բանակցային գործընթացում բոլոր սկզբունքները եւ դետալները համաձայնեցնելու միջոցով, այսինքն` փաթեթային եղանակով, թե՞ աստիճանաբար, հընթացս, այսինքն՝ փուլային։ Չնայած այս հարցում հստակ անորոշությանը, այն սկզբունքային նշանակություն ունի, որը, սակայն, երեք նախագահները հմտորեն շրջանցել են։

3. Փաստաթղթում ոչ մի խոսք, ակնարկ անգամ չկա այն մասին, թե ովքեր են հակամարտության կողմերը։ Ավելին, Լեռնային Ղարաբաղը` իբրեւ կողմ, հակամարտության սուբյեկտ, ընդհանրապես անտեսված է։ Այս հանգամանքը Հայաստանը ոչ թե բանակցող, այլ հակամարտող կողմի է վերածում` դրա բոլոր բացասական հետեւանքներով։

Yeah! Right! When did the f#%*$ furks learn to make tanks and canons, ever since the "Topji-ians" (canonmakers)and the "Tufenk-ji-ians"(gunsmiths) were massacred?
You mean, they are learning how to make tanks and canons from the telavivians and the Canaanites? ohmy.gif huh.gif

underestimating the enemy is not wise. I bet those tanks are American designed.Perhaps licensed for a fee.The point is what are we doing?

BAKU - A senior Turkish bureaucrat said on Friday that Azerbaijan might join Turkey`s project to manufacture new tanks.
Murad Bayar, the undersecretary for Turkish Defense Industries, said that Turkey aimed to manufacture new tanks for the Turkish Armed Forces.
"Some of these tanks could be manufactured in Azerbaijan, and some can be produced in Turkey," Bayar told "Milaz" news agency --the first private military information agency in Azerbaijan.
The bureaucrat expressed thought that a related agreement could be signed and the project could be launched within this month.
Bayar said that Turkey also planned to modernize its actual tanks including "Leopard" (Germany) and "M-60" (USA), and told the agency that Turkey proposed Azerbaijan to modernize its T-72 tanks.
"We may make joint production with Azerbaijan in line with this country`s needs in the future," Bayar also said.
Bayar enumerated the areas in which Turkey and Azerbaijan could cooperate as manufacturing military ships, unmanned aircraft and infantry rifle.
The Turkish bureaucrat said that Turkey was cooperating with not only Azerbaijan but also with Kazakhstan, Georgia, Balkan countries, former East Bloc countries, particularly Poland, in the area of defense industry.
Accompanied by representatives of several Turkish defense industry institutions including ASELSAN and Roketsan, Bayar paid a visit to the Azerbaijani capital of Baku between July 7th and 11th.
During the visit, Bayar visited Azerbaijani Ministry of Defense, Ministry of Defense Industry, Ministry of National Security and some military facilities.
"Milaz" is a news agency founded recently by a few Azerbaijani non-governmental organizations and research institutions. It is dealing with military and defense issues in Azerbaijan and its vicinity.
One of the main tasks of the Undersecretariat for Turkish Defense Industries is to re-organize and integrate the existing national industry so as to satisfy defence industry requirements, encourage new enterprises and channel them according to the integration and requirements, seek possibilities for foreign capital and technology contribution, guide enterprises and make plans for state participation in this respect.
The Turkish defense industry is forecast to have an annual export figure of 1.5 billion USD within three years.

Leader of the Union for National Self-Determination (AIM) Paruyr Hayrikyan doesn’t consider the Moscow declaration signed by the Presidents of Armenia and Azerbaijan on November 2 as a dangerous one. He underscores that the declaration rules out the settlement of the Karabakh conflict by force. Moreover, the conflicting sides, Armenia and Azerbaijan, have agreed to collaborate over some issues. The declaration doesn’t imply new menaces for Armenia.

Generally, the AIM Leader does not think that the sides will reach an agreement on the conflict resolution by the turn of the year as “such intricate conflicts cannot be resolved in a few months.”

Paruyr Hayrikyan says for the sake of Artsakh’s self-determination Armenia should withdraw from the negotiations and go guarantee for security of Karabakh people. “After considering the issue with the opposition and different political forces Armenia should announce that after revealing serious variances it doesn’t want to present Artsakh’s interests in the international circles and enter into conflicts with its neighbours,” stressed Mr. Hayrikyan.

The head of an unrecognized Armenian republic has described the current format of internationally mediated peace talks faulty and called for restoring Nagorno-Karabakh’s status as a party to the process currently involving Armenia and Azerbaijan. In an interview with RFE/RL, Nagorno-Karabakh President Bako Sahakian welcomed the latest efforts of the international community aimed at promoting dialogue and providing a better environment for negotiations, but warned that efforts to achieve an ultimate solution to the protracted conflict will remain unsuccessful until Nagorno-Karabakh returns to the negotiating table as a full party. “We have always emphasized in our statements that a broad dialogue is needed. But at the same time we have repeatedly said that such a dialogue and efforts being made by the international community to find a solution to the problem will remain faulty without Nagorno-Karabakh’s participation,” Sahakian stressed. Following talks earlier this month hosted by Russian leader Dmitry Medvedev, the presidents of Armenia, Azerbaijan and Russia signed a joined declaration pledging to step up the prolonged search for a peaceful resolution of the conflict amid growing international hopes for a breakthrough in Armenian-Azerbaijani peace talks mediated by Russia, the United States and France. The Moscow declaration became the first document simultaneously bearing the signatures of the leaders of Armenia and Azerbaijan since the two states signed a Russia-brokered ceasefire agreement in 1994. Remarkably, the 1994 truce deal also included the signature of a Nagorno-Karabakh representative. Against the backdrop of intensified international efforts to promote an agreement between Armenia and Azerbaijan regarding the principles of settling the long-running dispute, some observers perceived the declaration as a formalization of the reality in which Armenia has acted in the negotiating process on behalf of Nagorno-Karabakh. Nagorno-Karabakh, a predominantly Armenian-populated former region of Soviet Azerbaijan, broke free of Baku’s control in the early 1990s, prompting a military response from the latter that led to a full-blown war between Armenia-backed Karabakh defense groups and better-equipped Azerbaijani armed forces. After nearly three years of fighting, Karabakh Armenians managed to establish control over the majority of the ex-Soviet autonomous region’s territory and deploy their forces outside Nagorno-Karabakh proper to form a security zone surrounding the area. Nagorno-Karabakh was originally a party to the international negotiations conducted through the Minsk Group of the Organization for Security and Cooperation in Europe (OSCE). But Yerevan took over its representation after Robert Kocharian, Nagorno-Karabakh’s former president, became head of state in Armenia in 1998. “During all meetings, especially those with the participation of the Minsk Group cochairmen, we have asked and even demanded that they use their authority and powers and restore today’s disturbed format and translate into action the decision of the OSCE Budapest summit of 1994 that recognized Nagorno-Karabakh as a full party to negotiations,” Sahakian said. “We take the same approach in our contacts with authorities in Armenia urging Yerevan to make efforts to restore Nagorno-Karabakh’s participation in the negotiating process.” Sahakian refused to give any evaluation to the principles of conflict resolution that the leaders of Armenia and Azerbaijan are said to be close to agreeing on. He said that Nagorno-Karabakh has its own viewpoints and repeated that it can address “the whole package” only after returning to the negotiations as a full party. “When we speak about one principle or another, whether it is the so-called Madrid principles or any others, we realize that all principles must first of all be agreed with Nagorno-Karabakh’s authorities,” Sahakian underscored. “Only in that case can we think about translating those principles into life.”

OPPOSITION PARTY RESISTS ‘ILLEGAL’ KARABAKH DEAL

A small Armenian political party opposed to the current administration has expressed its strong concern over possible concessions in the continuing Armenian-Azerbaijani peace talks over Nagorno-Karabakh that it says Armenia’s current leadership has not been empowered to agree to. The Social-Democratic Hunchak Party, which is a member of former President Levon Ter-Petrosian’s opposition alliance, issued a statement Monday criticizing President Serzh Sarkisian for formally ending the hopes of the unrecognized republic to regain its status as a party to the internationally mediated peace talks by signing a declaration, along with the presidents of Azerbaijan and Russia, calling for a direct dialogue between Yerevan and Baku. It said the international organizations pushing for a speedy resolution of the conflict would bear responsibility for any document concerning the future of Nagorno-Karabakh signed by Armenia’s leadership that, the party holds, lacks the delegated rights from the Armenian people to act on their behalf. “It is Nagorno-Karabakh that is the real party to the conflict and Stepanakert has not made any decision authorizing Yerevan, let alone Armenia’s current illegitimate authorities, to negotiate a deal or make decisions on its behalf,” the Hunchak Party said in its statement. Gurgen Yeghiazarian, a senior party representative, said the Moscow declaration has confirmed the ‘disgraceful’ fact that the Karabakh conflict has two sides, i.e. Azerbaijan and Armenia, and therefore has completely ousted Nagorno-Karabakh from the current peace process. Another senior party figure Vahan Shirkhanian alleged that the solution offered to the sides is leading directly to war. “International structures lay an ever-acting landmine in the South Caucasus that may explode any time they wish. Getting the Karabakh conflict resolved this way means that the next war will be much fiercer and destructive for all peoples of the South Caucasus,” said Shirkhanian, who served as Armenia’s deputy defense minister throughout the 1990s. “It is vitally important that the people and authorities of Karabakh present their clear standpoint on the current situation.” Another former deputy defense minister Artur Aghabekian also called unacceptable the format of negotiations that does not include Nagorno-Karabakh as a party. Talking to RFE/RL on Monday, the pro-establishment lawmaker, who currently heads the parliamentary standing committee for defense, internal affairs and national security, disagreed with the declaration as far as this fact is concerned, but stopped short of dramatizing the consequences of the nonbinding document. “Armenia, Nagorno-Karabakh and Azerbaijan still have a long way to go before they reach a settlement of the problem,” said Aghabekian, of the Armenian Revolutionary Federation. “The Armenian society is not prepared for a Karabakh solution based on the so-called Madrid principles. Since 1994, Azerbaijan’s society has not heard anything but calls for maintaining the country’s territorial integrity and threats to resolve the matter militarily, failing all other options. The population of Nagorno-Karabakh is not ready for a solution either. And if the peoples are not ready, the authorities cannot solve the problem.”

Gul also mentioned that Turkey supports the presidents' meeting in Moscow and "believes that the process will develop successively".

NEXT MEETING OF ARMENIAN AND AZERBAIJANI PRESIDENTS TO BE PROBABLY HELD IN TURKEY

The next meeting of the Azerbaijani President Ilham Aliyev and Armenian President Serzh Sargsian will be held in the nearest future in Istanbul on the initiative of Turkish President Abdullah Gul, Turkish "Zaman" reported.

According to the newspaper, the issue of holding a new meeting was discussed during Ilham Aliyev's visit to Ankara this week. The latter gave a positive answer to the initiative of the Turkish side.

"Now Ankara will send the proposal for holding the meeting to the Armenian side, after which the date and the place of the meeting will be fixed", the newspaper writes quoting from diplomatic sources.

Azerbaijani Foreign Minister Elmar Mammadyarov answered the questions of "Zaman" mentioning that the agenda of the meeting will be fixed by the country accepting the proposal. According to him, the discussions between Aliyev and Sargsian will not be limited to discussions of prospects for settlement.

without participation of Karabakh itself in talks, a Russian politician
said.

"The Moscow declaration is a unique document, since it ruled out
resolution of the conflict by use of force. As to Azerbaijan's
statements that Russia will "cede Karabakh and bunko Armenia", they are
extremely improper. Russia can't cede a land which doesn't belong to
it," Konstantin Zatulin, State Duma member, director of the institute
of CIS studies, told a news conference today.

During the November 2 meeting, the Presidents Dmitry Medvedev of
Russia, Serzh Sargsyan of Armenia and Ilham Aliyev of Azerbaijan
signed a declaration envisaging resolution of the Karabakh conflict
on the basis of principles and norms of the international law.

Russia, like Armenia, is not prepared to recognize independence of
Nagorno Karabakh yet, according to him.

"However, recognition is inevitable. During 17 years, Karabakh
proved its being a developing and democratic state, contrary to
Azerbaijan. Besides, no one can insist that the right of nations to
self-determination is a secondary principle. I am confident Nagorno
Karabakh will be recognized as an independent entity sooner or later,"
Zatulin said.

  • The meeting of President Serzh Sargsyan with party leaders on the Nagorno-Karabakh conflict has kicked off at the Yerevan Karen Demirchyan sports/complex center and it is behind closed doors.

    Among participants are Vazgen Manukyan, leader of the Democratic Party Aram Sargsyan and leader of the Marxist Communist Party David Hakobyan, while the leaders of the parties representing the Armenian National Congress are not taking part in the meeting. However, head of the “Heritage” opposition faction Anahit Bakhshyan has accepted Sargsyan’s invitation.

Serzh Sargsyan met with political party leaders at the Karen Demirchyan sport/concert complex behind closed doors in order to avoid populism and hold an open meeting. In the beginning of the four-hour long meeting, Serzh Sargsyan congratulated the political party leaders on the occasion of the victory of the chess players and informed that the discussions with political parties on issues of social concern will take place on a regular basis.

Almost all of the political parties were participating in the meeting, except the radical opposition parties, that is, the parties representing the Armenian National Congress. However, leader of the Marxist Party David Hakobyan was present.

Artur Baghdasaryan and Armen Rustamyan represented the coalition. Gagik Tsarukyan wasn’t there because he is currently out of the country. Among participants were the three national democracy supporters Vazgen Manukyan, Shavarsh Kocharyan and Arshak Sadoyan. Harutyun Arakelyan represented the Armenian Ramkavar Liberal Party. Other participants included Paruyr Hayrikyan, Khosrov Harutyunyan, Aram G. Sargsyan, Hayk Babukhanyan, Communists Ruben Tovmasyan and Yuri Manukyan, as well as leader of the National Security party Garnik Isagulyan and others.

The only women political figures were member of the “Heritage” political party Anahit Bakhshyan and heads of two women’s organizations. Journalists couldn’t recognize many of the faces. For example, they didn’t understand what party Ernest Soghomonyan represented. The latter is a member of the “Prosperous Armenia” party faction. He is also leader of the Hnchakyan party, but hasn’t represented himself as leader of that party for a long time.

From the start, Serzh Sargsyan announced that political parties shouldn’t make references to the opinions expressed during the meeting because what is discussed must stay confidential. Thus, ten minutes after the start of the meeting journalists were asked to leave and waited four hours for the political party members. When they came out for breaks, they just told us where they stand on the Karabakh conflict and not a word about the discussion. But we were able to find out that all invited parties had only presented their stance and in the end Serzh Sargsyan would touch upon the issues raised. We will present the stances of the parties later.

SARKISIAN DISCUSSES KARABAKH WITH ARMENIAN POLITICAL PARTIES

President Serzh Sarkisian on Thursday held an extended discussion focusing on the Karabakh issue with leaders of Armenia’s political parties that had responded to his invitation to attend the meeting. None of the leaders of key political parties making up the opposition Armenian National Congress (HAK) alliance attended the gathering, though. The Armenian president straightaway imposed a condition that no direct references to the speakers at the event be made in further public exchanges of views or political statements. In his opening remarks, Sarkisian, in particular, said that the discussions would be in a ‘closed format’ and ‘without references’. “Without references means that after this meeting, in our public activities we can refer to the thoughts voiced here. But we must agree that we don’t make direct references to speakers expressing particular thoughts. This format will make it possible for all participants to feel free to express any position during this discussion,” the president explained. The meeting then proceeded behind closed doors. Among the major opposition parties attending the discussion was Zharangutyun (Heritage), the only opposition party currently represented in the Armenian parliament that backed the HAK’s current leader and ex-president Levon Ter-Petrosian in last February’s presidential election. Ter-Petrosian himself had not been invited as formally he is not a political party leader. In motivating their refusal to attend the gathering, the major opposition parties cited the continuing imprisonment of scores of their members and supporters in what they described as ‘politically motivated cases.’ All members of the governing coalition, except the leader of Prosperous Armenia Gagik Tsarukian, who was said to be outside Armenia, had their leaders attending the meeting hosted by President Sarkisian, himself the leader of the majority Republican Party. In particular, the Armenian Revolutionary Federation (Dashnaktsutyun) was represented by Party Supreme Body representative and head of the parliamentary foreign relations committee Armen Rustamian and Orinats Yerkir was represented by National Security Council Secretary Artur Baghdasarian. Among the key opposition politicians not supporting the Ter-Petrosian alliance who were present at the meeting were Vazgen Manukian from the National-Democratic Union, Artashes Geghamian from the National Accord party, Paruyr Hayrikian from the National Self-Determination Union and others. After the meeting that lasted for nearly five hours, Zharangutyun’s Anahit Bakhshian singled out Sarkisian’s assurances about a Karabakh problem that will “satisfy all strata of society.” “The president said there will be a document that will satisfy the Armenian people,” she summarized to the media. “What is important to me is that he [Sarkisian] said there is no normal Armenian who would recognize Nagorno-Karabakh’s self-determination within Azerbaijan. I very much want to believe him no matter on what side of the political fence I am now.” Armen Rustamian told the media that he had forwarded to Sarkisian a set of principles that Dashnaktsutyun deems paramount in approaching a Karabakh settlement. “The basic one is that the negotiations must be based on the already expressed will of the people of Nagorno-Karabakh,” Rustamian said. Dashnaktsutyun, according to its representative, also holds that solutions to all issues connected with the settlement must be clear from beginning to end. Otherwise, the party believes, it will resemble an interim solution. In the issue of withdrawing from territories and ensuring the return of refugees, the nationalist party upholds the demand for the lands of Nagorno-Karabakh proper that are currently controlled by Azerbaijan. “These are the lost territories of Nagorno-Karabakh that total more than a thousand square kilometers,” Rustamian said. “The demand must be laid on the negotiating table as our territorial claims, because these are the territories of the Nagorno-Karabakh Republic.” Rustamian also said that Dashnaktsutyun is for a clear separation of the roles of Nagorno-Karabakh and Armenia in the negotiating process. “It should be clearly fixed that the Nagorno-Karabakh Republic is an independent party to the conflict and Armenia must not supplant Nagorno-Karabakh, but should act as a party involved in the conflict. The circumstance of Armenia’s being the guarantor of Nagorno-Karabakh’s independence and security should also be considered in these issues,” he concluded.

NEO-BOLSHEVIKS LEARN A LOT FROM BOLSHEVIKS

After the recent regional visit of the OSCE Minsk Group Co-Chairs, the prospects of conflict settlement have somehow become dependent upon the discussions to be held Armenia and Azerbaijan.

The fact that such discussions in our reality are initiated by the authorities themselves can be considered quite normal and conceivable. After all, it is known to everybody that the Karabakh conflict and the subsequent confrontation with Azerbaijan was the expression of the collective will of the whole nation vs. a separate political party or individual. Therefore, regardless the current of the negotiation process, their approval or rejection cannot be the monopoly of the state authorities which are in power at the given moment.

Moreover, the present-day authorities’ initiative of organizing discussions with the political forces or the task of uniting the pan-national efforts for moving forward with any option of settlement is just what all the Armenian pro-opposition forces have been speaking about for around 1.5 decade. And all that continued till the moment when the President of the Republic invited them to discussions over the Karabakh issue.

And surprising though it is, it was at this moment that the attitudes of the radical opposition took a turning to the opposite direction.

Now, the leaders of the Armenian National Congress are developing the opposite viewpoint, inventing different excuses and refusing to accept the President’s invitation. As to why their excuses are invented is because neither the Karabakh issue nor the permanent interests of our state and people can be considered exhausted just because the pro-opposition figures refuse to admit the results of the recent presidential elections or find that releasing the individuals arrested as a result of the March 1-2 incidents is necessary for initiating a dialogue.

In this respect, A. Z. Sargsyan’s refusal to participate in the discussions over the Karabakh issue cannot but be considered a primitive argument in the neo-Bolshevik style. “If I am an individual staging a coup d’état, there’s no need to know my opinion.” A question arises as to whether A. Z. Sargsyan has been invited to discuss an internal political agenda or to express his views on the Karabakh issue, a problem that unites all of us.”

Let me note that discussions over the Karabakh issue were held in our reality even at the times when there was no electoral system in the country and Karen Demirtchyan, the First Secretary of the Armenian Communist Party, invited a number of renowned intellectuals and listened to their views with attention. And none of these people would persistently refuse to meet with the First Secretary just because he had been elected to his post by the decision of the Political Bureau of the Communist Party of the Soviet Union.

Or let’s take, for instance, the year 1997, when the outcomes of the 1996 elections were known to all of us, and the international community wouldn’t accept L. Ter-Petrosyan’s legitimacy. However, that didn’t put an end to the discussions over the Karabakh issue among the political forces and political figures. And such discussions should continue especially now that the international community no longer questions the legitimacy of the new Armenian President.

One of the excuses of the opposition is that President S. Sargsyan will use such discussions as a tool “for showing our national unanimity to the states interested in the NKR issue, but as a matter of fact, he will thus avoid responsibility in the negotiations process.”

Of course, with the help of the political parties representing them, the Armenian people are obliged to demonstrate their inflexible will of achieving the fair solution of the Karabakh issue. After all, if S. Sargsyan’s positions are strengthened in the negotiations, that will be the victory of the country rather than the authorities.

Whereas it turns out that some people intend to lay the responsibility on the top representative of the authorities, weaken the positions of the incumbent President and hence – the Armenian party so as Armenia will suffer defeat in the diplomatic contest but they will benefit as a result. And before that, it is necessary for them to satisfy themselves with L. Zourabyan’s slogan saying “we will support the NKR people”. However, the statement does not provide an answer to the question as which party such “support” will be directed against: Azerbaijan or the authorities of his own country.

This is the accurate reproduction of V. I. Lenin’s well-known slogan of achieving the defeat of his own country. These people are making attempts of attaining a similar result by way of separating the NKR people from the “blood-sucking leeches”, i.e. the representatives of the authorities of Armenia. That’s why “Lenin” has halted the wave of his demonstrations and gone “underground”.

The only difference is that Ilyich had hidden in a modest Finnish hut where he was dreaming about the defeat of the authorities of his own country whereas his Armenian adherent lives in a luxurious palace. But in such circumstances, this is an ordinary detail because the prospect of the diplomatic defeat of the ruling authorities of Armenia is, in this case, the same as the defeat of Armenia and the Armenian people for Karabakh.

Whereas the situation in Azerbaijan, our neighboring country, is just the contrary. That is, the opposition has set aside the disagreements with the authorities and in case of the slightest doubts that the latter are making concessions to the Armenian party, it accuses them of all the deadly sins. That’s the reason the recent statements of the Azerbaijani statesmen are targeted at the mutual concession clauses proposed by the OSCE Minsk Group, the idea of the NKR people’s right to self-determination being the central issue.

The picture is exactly the same as the situation with the Armenian Bolshevik-internationalists and the Azeri “Bolshevik moussavatists” in the 2nd decade of the past century. Finally, the discussions over the Karabakh issue in both countries are turning into game in the direction of one gate, with the defeat of the Armenian diplomacy being in the interests of not only the political circles of Azerbaijan, but also a significant part of the Armenian opposition, i.e. the Ter-Petrosyan-led Armenian National Congress.

The former needs to return Karabakh of which it was deprived in the battlefield while the latter wants return the power it lost in Armenia.

The Moscow declaration signed by Presidents of Russia, Azerbaijan and Armenia is a roadmap envisaging possible ways to resolve the Nagorno Karabakh conflict, Russia’s Ambassador to Azerbaijan said. “Although Nagorno Karabakh is not a signatory of the declaration, it does not mean that NK can’t take part in the negotiation process,” Vasily Istratov said. “There are plenty of opinions on the issue but we should proceed from provisions of the declaration,” he said, Novosti Azerbaijan reports.

Ադրբեջանական կողմը, պաշտոնական թե ոչ պաշտոնական մակարդակներով, այդ ընթացքում փորձում էր համոզել, թե քանի որ հակամարտության կարգավորման բանակցային գործընթացը ի սկզբանե ընթանում է ԵԱՀԿ շրջանակներում, ապա պետք է հաշվի առնվեն միայն այդ կազմակերպության կողմից ընդունված իրավական ակտերը։ Եվ իբրեւ այդպիսին վկայակոչվում են 1975 թ. Եվրոպայում անվտանգության եւ համագործակցության խորհրդի կողմից ընդունված հիմնարար «Եզրափակիչ ակտով» սահմանված նորմերը, որոնք միանշանակորեն երաշխավորում են տարածքների եւ սահմանների անձեռնմխելիության սկզբունքը։

Ամեն դեպքում ակնհայտ է, որ առաջիկայում քննարկումների, բանավեճերի եւ ընդհանրապես քարոզչական պատերազմների հիմնական թեման լինելու է այն հարցը, թե ո՞ր իրավական ակտերն են հաշվի առնվելու կարգավորման գործընթացում, որքանո՞վ են դրանք բխում այս կամ այն կողմի շահերից։

Ակնհայտ է, որ իսկապես, Ղարաբաղյան կարգավորման համար հաշվի են առնվելու ԵԱՀԿ, ՄԱԿ-ի եւ Եվրոպայի Խորհրդի կողմից ընդունված միջազգային իրավական ակտերն այն պարզ պատճառով, որ անդամակցելով այդ կազմակերպություններին` թե' Հայաստանը, եւ թե' Ադրբեջանը, փաստորեն, ստորագրել են դրանց տակ, այդ թվում նաեւ ՄԱԿ-ի Անվտանգության խորհրդի կողմից 1993 թ. ընդունված վերոնշյալ 4 բանաձեւերը, որոնք չնայած զուտ խորհրդապահական նշանակություն ունեն, սակայն տրված ձեւակերպումների, մոտեցումների իմաստով լինելու են բոլորի ուշադրության կենտրոնում։ Սակայն պնդել, որ այդ բանաձեւերը միանշանակորեն բխում են Ադրբեջանի շահերից, ուղղակի մոլորություն կլիներ, եւ ահա թե ինչու։

Իսկապես, այդ բանաձեւերը միանշանակորեն պաշտպանում են Ադրբեջանի տարածքային ամբողջականությունը եւ ինքիշխանությունը, մյուս կողմից` Լեռնային Ղարաբաղը նշվում է իբրեւ Ադրբեջանի մաս. «կոնֆլիկտ Ադրբեջանի Լեռնային Ղարաբաղի շրջանում»։

Սակայն, այդ բանաձեւերում չի նշվում, թե ով է ագրեսիա իրականացրել Ադրբեջանի տարածքային ամբողջականության նկատմամբ։ Ավելին, իբրեւ այդպիսի կողմ, նշվում է միայն անորոշ «օկուպացիոն ուժերի» ամբողջական եւ անվերապահ դուրսբերման մասին։ Ավելին` ՄԱԿ-ի ԱԽ-ի 1993 թ. վերջին՝ նոյեմբերի 12-ին ընդունված բանաձեւում նշվում է, թե ԱԽ-ն «կոչ է անում Հայաստանի կառավարությանն օգտագործել իր ազդեցությունը, որպեսզի Ադրբեջանի Լեռնային Ղարաբաղի շրջանի հայերը պահպանեն ԱԽ կողմից ընդունված բանաձեւերի պահանջների կատարումը եւ ապահովի, որպեսզի ռազմական գործողությունները շարունակելու համար ներգրավված ուժերին միջոցներ չտրամադրվեն»։ Այլ կերպ ասած՝ Լեռնային Ղարաբաղի կոնֆլիտը հենց ՄԱԿ-ի ԱԽ-ի կողմից մեկնաբանվել եւ մատուցվել է որպես Ադրբեջանի ներքին, այսինքն` էթնիկ միավորի ինքնորոշման խնդիր, որտեղ Հայաստանը հանդես է գալիս ոչ թե հակամարտության կողմ, այլ ընդամենը «Ղարաբաղի հայերի վրա ճնշում գործադրելու» պոտենցիալ ունեցող երկիր, ինչը, անշուշտ, նաեւ հայկական կողմին մանեւրելու հնարավորություններ է տալիս։

Հետեւաբար, սա ոչ թե հայ-ադրբեջնական կոնֆլիկտ է, ինչպես, վերցնելով ադրբեջանցիներից, թյուրիմացաբար կրկնում են նույնիսկ հայ փորձագետները, այլ ղարաբաղա-ադրբեջանական կոնֆլիկտ։ Ահա այս հանգամանքի վրա շեշտադրումները կատարելիս հայկական կողմը ոչ միայն կարող է նույն ՄԱԿ-ի բանաձեւերի վրա հղում կատարելով պնդել, որպեսզի ԼՂ-ն դառնա բանակցությունների լիիրավ կողմ, այլեւ բանակցություններից դուրս գալու սպառնալիք ներկայացնի անհրաժեշտ պահին։

Երբ կոնֆլիկտը դիտարկվում է որպես էթնիկ միավորի ինքնորոշման խնդիր, ապա գոյություն չունի որեւէ միջազգային իրավական ակտ, որը տարածքային ամբողջականության սկզբունքին հեգեմոնության կարգավիճակ տա։ Դա հիանալի հասկանում են նաեւ Ադրբեջանում, եւ հենց դա է պատճառը, որ նրանք ամեն ջանք գործադրում են, որպեսզի հակամարտությունը ներկայացվի ոչ թե որպես ներքին, ղարաբաղցիների ինքնորոշման խնդիր, այլեւ հատկապես հայաստանա-ադրբեջանական կոնֆլիկտ Ղարաբաղի տարածքի համար, որտեղ պարզից էլ պարզ է, որ Հայաստանը, ուզի թե չուզի, հանդես է գալու իբրեւ ագրեսոր, որը Ղարաբաղի տարածքին տիրանալու համար խախտել է սուվերեն երկրի միջազգային սահմանների անխախտելիության սկզբունքը եւ օկուպացրել է Ադրբեջանի տարածքների 20 տոկոսը։

Հետեւաբար, ըստ Ադրբեջանի, խնդիրը ոչ թե Ղարաբաղի, այլ հենց Հայաստանի հետ է։ Իսկ այդ դեպքում Հայաստանը դառնում է ԵԱՀԿ 1975 թ. «Եզրափակիչ ակտ»-ով սահմանված առաջին («Ինքնավարության իրավահավասարություն, ինքնիշխանությանը հատուկ իրավունքների հարգում»), երկրորդ («Ուժի կամ ուժի սպառնալիքի չկիրառում») եւ երրորդ («Սահմանների անխախտելիություն. մասնակից պետությունները միմյանց եւ Եվրոպայի բոլոր երկրների սահմանները ճանաչում են որպես անխախտելի եւ դրա համար նրանք հիմա եւ ապագայում ձեռնպահ կմնան այդ սահմանների նկատմամբ ցանկացած նկրտումներից») եւ չորրորդ՝ («Պետության տարածքային ամբողջականություն...անդամ-պետությունները կհարգեն յուրաքանչյուր անդամ պետության տարածքային ամբողջականությունը») սկզբունքները։

Հենց դրանց է հղում կատարում ադրբեջանական կողմը, երբ պնդում է, թե մայենդորֆյան հռչակագիրը ենթադրում է առաջին հերթին ԵԱՀԿ «Եզրափակիչ ակտով» սահմանված նորմերի կատարում։ Մինչդեռ նույն, ունիվերսալ այս փաստաթուղթը շատ կոնկրետ խոսում է նաեւ ազգերի ինքնորոշման սկզբունքից, որի մասին, չգիտես ինչու, բոլորը լռում են։ Դրանք սահմանված են «Եզրափակիչ ակտի» յոթերորդ՝ («Մարդու իրավունքների եւ հիմնարար ազատությունների հարգում՝ ներառյալ մտքի, խղճի, կրոնի եւ համոզմունքների ազատությունը. անդամ պետությունները, որոնց տարածքում կան ազգային փոքրամասություններ, նրանց կտրամադրեն մարդու իրավունքների եւ հիմնարար ազատությունների կիրառման լիարժեք իրավունք եւ այդ կերպ կպաշտպանեն նրանց օրինական շահերն այդ ոլորտում»), եւ ութերորդ («Սեփական ճակատագիրը տնօրինելու ժողովուրների իրավունքը եւ իրավահավասարությունը...բոլոր ժողովուրդները միշտ իրավունք ունեն լիարժեք ազատության պայմաններում երբ եւ ինչպես որոշելու՝ իրենց ներքին եւ արտաքին քաղաքական կարգավիճակը՝ առանց արտաքին միջամտության»)։

Ճիշտ է՝ այնտեղ նշվում է նաեւ, որ պետք է հաշվի առնվի պետությունների տարածքային ամբողջականության սկզբունքը, սակայն պետք է ըմբռնել, որ 1991թ. սեպտեմբերի 2-ին կայացած հանրաքվեն հենց այդ սկզբունքի հարգման եւ կիրառման արդյունք էր՝ անկախ նրանից՝ պաշտոնական Բաքուն ճանաչու՞մ է դրանց արդյունքները, թե՞ ոչ։ Եվ հիմա հայկական դիվանագիտության խնդիրը պետք է լինի այդ հանրաքվեի արդյունքների միջազգայնորեն լեգիտիմացումը, ինչը հնարավոր է միմիայն ԼՂՀ-ի՝ բանակցային գործընթացում ներգրավվելու միջոցով։

Բոլոր դեպքերում չափազանց անլուրջ է նաեւ Ադրբեջանի այն պնդումը, թե բանակցությունները պետք է հիմնված լինեն միայն ԵԱՀԿ շրջանակներում ընդունված նորմերի հիման վրա, որովհետեւ միջազգայնորեն ընդունված սկզբունքները ունիվերսալ են եւ այս կամ այն ձեւակերպմամբ ընկած են գրեթե բոլոր հիմնարար միջազգային պայմանագրերի, պակտերի հիմքում։ Նույն ԵԱՀԿ «Եզրափակիչ ակտ»-ում բազմիցս հղում է կատարվում ՄԱԿ-ի կանոնադրությամբ եւ հատկապես «Քաղաքացիական եւ քաղաքական իրավունքների մասին միջազգային պակտին», որոնք եւս այդ սկզբունքներից որեւէ մեկին առավելություն չեն տալիս։

ՄԱԿ-ի կանոնադրության հենց առաջին հոդվածը շեշտում է. «Բարիդրացիական հարաբերություններ հաստատել ազգերի միջեւ՝ հիմնված իրավահավասարության եւ ժողովուրդների ինքնորոշման սկզբունքի վրա..»։ Իսկ 4-րդ կետի տակ նշվող պայմանը՝ «ՄԱԿ-ի անդամներն իրենց միջազգային հարաբերություններում ձեռնպահ են մնում ուժի սպառնալիքից կամ ուժի կիրառումից ինչպես տարածքային անձեռնմխելիության կամ ցանկացած երկրի քաղաքական անկախության դեմ», ոչ թե ներքին խնդիրների կարգավորմանն է վերաբերում, այլ երկրների, պետությունների միջեւ հարաբերություններին եւ ոչ մի կապ չի կարող ունենալ ԼՂ հիմնահարցի հետ։

Իսկ «Քաղաքացիական եւ քաղաքական իրավունքների մասին միջազգային պակտը» առավել քան պարզ հռչակում է. «Բոլոր ժողովուրդներն ինքնորոշման իրավունք ունեն։ Այդ իրավունքի ուժով նրանք ազատորեն հաստատում են իրենց քաղաքական կարգավիճակը եւ ազատորեն ապահովում են իրենց տնտեսական, սոցիալական եւ մշակութային զարգացումը։ ...Այս պակտին մասնակից բոլոր պետությունները, ներառյալ նրանք, որոնք պատասխանատվություն են կրում ոչ ինքնավար եւ ենթակա տարածքների համար, պետք է ՄԱԿ-ի կանոնադրությանը համապատասխան ընդլայնեն ինքնորոշման իրավունքի իրացումը եւ հարգեն այդ իրավունքը»։

Հետեւաբար, մայենդորֆյան հռչակագրում հակամարտությունը միջազգային նորմերին համապատասխան քաղաքական բանակցությունների միջոցով լուծելու մասին հիշատակումը, բացի վտանգներ պարունակելուց, նաեւ հայկական կողմին բանակցություններում մանեւրելու, կռվաններ գտնելու եւ կորցրած դիրքերը վերադարձնելու հնարավորություններ է տալիս։ Խոսքն առաջին հերթին ԼՂՀ-ի՝ բանակցություններում անպայմանորեն, որպես լիարժեք անդամ ներգրավվելու մասին է։ Դժվար է ասել՝ արդյոք վերոնշյալ իրողությունների հիման վրա հայկական դիվանագիտության ճնշման արդյու՞նք էր Մինսկի խմբի համանախագահների աննախադեպ երկարատեւ այցը Ստեփանակերտ։ Սակայն դա լուրջ նախադրյալ է եւ կարող է նոր հեռանկարներ բացել բանակցություններում։
