The Armenian people deserve the  highest praise for human dignity, EU Ambassador to Armenia Piotr Świtalski on Wednesday said during the Universal Rights Awards Ceremony.

Comparing the situation with human rights in Armenia with previous years, Świtalski stressed that now the situation is completely different. He also added that the presence of Prime Minister Nikol Pashinyan at the award ceremony is symbolic.

According to him, the EU now speaks differently about human rights with Armenia and the Armenian people. 

According to the ambassador, three issues are of great importance to the European Union. He noted that the first one is the gender equality. The Prime Minister has repeatedly emphasized the importance of women's involvement in politics, business, and other spheres of life after the revolution, the ambassador added.

According to the ambassador, the second one is the fight against discrimination. Świtalski noted that people of the second class should not be in Armenia . The EU monitors the fight against discrimination,  against people of different sexes, religions, sexual orientation, ethnicity, the ambassador noted.

The social and labor rights, according to him, are the third one. Świtalski also mentioned that the Government of the Republic of Armenia stresses the importance of social and labor rights in its program.

YEREVAN, FEBRUARY 21, ARMENPRESS. Alexander Sargsyan, former MP, brother of ex-president Serzh Sargsyan, has paid 11.5 million USD to the state as a compensation for tax evasion, abuses. Earlier, he transfered18.5 million USD to the state, NSS Director Artur Vanetsyan told the reporters.

Vanetsyan added that the criminal case is still in process and there will be new information about Alexander Sargsyan's possessions.

Generally speaking, it’s wrong to ask why this or that person is not arrested yet. This is what Prime Minister of the Republic of Armenia Nikol Pashinyan stated in response to questions from citizens live on Facebook today, touching upon a question on why no charge has been brought up against Serzh Sargsyan yet.

“There are dozens of corruption cases in Armenia. Manvel Grigoryan and Robert Kocharyan are under custody, and the former minister of nature protection and the former chief of the Compulsory Enforcement Service are wanted. There are dozens of cases against former high-ranking officials. Neither I nor anyone has set the objective to sentence a person with a particular name or last name, be it Serzh Sargsyan or Robert Kocharyan, but we have said that everyone is equal before the law,” he said.

He recalled that when Manvel Grigoryan was remanded, social media website users said the government was remanding a national hero, but when the truth about Manvel Grigoryan was revealed, nobody ever said anything again.

“I can’t say whether Serzh Sargsyan will be charged or not. I’m neither an investigator nor a prosecutor, but when there will be necessary and sufficient grounds for a charge, there will be no political impediment,” the Prime Minister emphasized.

He also highlighted the fact that there have not been and there will not be any agreements behind closed doors. “I will not do that because this will mean that not only the revolution, but also my life is meaningless. For instance, a criminal case was instituted in relation to the North-South Road Program a couple of months ago, and it is assumed that there are officials involved in the case. There are still no such officials because the case is extensive, and I have demanded that the case be investigated by law.

I tell you there will not be any vendetta, but justice will be served. I’m not content with the process and the results, but there are reasons for that. For instance, when the scenes of the search of the home of Manvel Grigoryan were released, corrupt officials eliminated all that they had in their homes,” Pashinyan declared and asked the people not to suspect him of conspiracies.

Hello,

President Dr.Armen Sarkissian so far doing very good job after more then year but he came from England , I preferred Armenian Citizen should have given the job, more experience internal part of the country if he was foreign affairs should have been great. but do not be greedy , lets applause his work coming years and best luck to him.,

President Sarkissian is the best thing that happened to Armenia, remember his position is ceremonial after the country became parliamentary system. He is showcasing Armenia to the world in a very positive and truthful way, no other politician did what he did in such a short time.

Pashinyan instigates protests outside Armenian courts calling for transitional justice

Pro­test­ers gathered outside courts across Armenia on Monday after Prime Minister Nikol Pashinyan called for sup­port­ers to block the entrances, describ­ing the courts as ‘puppets’ of the former gov­ern­ment.

Pashinyan made the request in a live Facebook address on Sunday evening, calling it the ‘second most important stage of the Armenian rev­o­lu­tion’.

In a televised speech during Monday’s cabinet meeting, Pashinyan said it was time for a ‘surgical inter­ven­tion’ in the country's judicial system and the beginning of ‘tran­si­tion­al justice’.

While Pashinyan did not refer to any specific verdict, he said that it was evident ‘the rulings of the courts are deeply untrust­wor­thy’ and that they were perceived as being a ‘leftover of the former corrupt regime’.

The move came a day after the Yerevan City Court released former president Robert Kocharyan, a longtime political foe, on bail.

Pashinyan also berated uniden­ti­fied opponents in Nagorno-Karabakh. The court freed Kocharyan after former and acting pres­i­dents of Nagorno-Karabakh, Arkady Ghukasyan and Bako Sahakyan respec­tive­ly, per­son­al­ly vouched for him and each deposited ֏500,000 ($1,000) bail.

Pashinyan further elab­o­rat­ed that because the judiciary ‘did not enjoy the people’s trust’, it was ille­git­i­mate, and was ‘becoming a direct threat to the stability and national security of our country’.

Pashinyan promised five steps to ‘regain people’s trust’ in the courts, including that all judges must undergo vetting so that the public gains com­pre­hen­sive knowledge about the origin and political ties of all judges.

He promised that judges whose decisions contained sig­nif­i­cant vio­la­tions of human rights according to ECHR rulings must resign or be fired, as should those judges who know ‘they are incapable of being impartial’.

He promised to complete the process of ‘tran­si­tion­al justice’ within two to three months, and did not rule out amending the con­sti­tu­tion ‘if necessary’.

‘Ties to the old regime’

Robert Kocharyan, who served as the second President of Armenia in 1998–2008 and as the first president of Nagorno-Karabakh in 1994–1997 is currently facing charges of over­throw­ing the con­sti­tu­tion­al order, over the violent dispersal on pro­test­ers in 2008.  

Kocharyan’s case, along with that of former officials Armen Gevorgyan, Seyran Ohanyan, and Yuri Khachatur­ov, has now been trans­ferred to the Con­sti­tu­tion­al Court, Armtimes cited Ohanyan’s lawyer as saying on Monday.  The prosecutor's office told Armtimes that they had ‘no such infor­ma­tion’.

In a post on Facebook, Vahe Grigoryan, a lawyer rep­re­sent­ing victims of the 2008 violence, said he had not been informed of the move.

Grigoryan also told RFE/RL that he and his col­leagues were not allowed to par­tic­i­pate in the hearing of the motion to release Kocharyan on bail.

Kocharyan was an ally of former Prime Minister Serzh Sargsyan, who Pashinyan ousted through popular anti-gov­ern­ment protests in the spring of 2018, a process he dubbed a ‘Velvet Rev­o­lu­tion’.

Before his speech outlining his plans for the judiciary, Pashinyan visited sup­port­ers protest­ing outside the Kentron Court in Yerevan. By this time, courts through­out Armenia including the Supreme Judicial Council and the Con­sti­tu­tion­al Court had been paralysed. Several MPs from the ruling My Step par­lia­men­tary group also joined the protests.

After his speech on Monday, Pashinyan called off the blockade of the cour­t­hous­es, sug­gest­ing a message of distrust towards the courts had been delivered. He said the pursuit of an inde­pen­dent judiciary in Armenia was now irre­versible now.  

Warnings of ‘populism’

The Supreme Judicial Council quickly responded Sunday evening with a statement calling the plans to disrupt the func­tion­ing of the courts ‘inad­mis­si­ble’.

A number of political groups and public officials, including the largest oppo­si­tion par­lia­men­tary party, Pros­per­ous Armenia, rebuked Pashinyan for his call to block court buildings.

Armenia’s Human Rights Defender Arman Tatoyan said in a statement late on Sunday that the call to blockade cour­t­hous­es was ‘highly dangerous for the security and stability of the country’s legal system’.

On Monday, Bright Armenia, an oppo­si­tion party that won 18 seats in the 2018 snap par­lia­men­tary elections, announced they would convene an extra­or­di­nary session in the National Assembly to discuss Pashinyan’s latest steps.

Armenian president Armen Sarkiss­ian also stepped into the fray on Sunday, calling on com­pa­tri­ots to show restraint and respect the country’s con­sti­tu­tion.

Since he was first appointed Prime Minister in May 2018, Pashinyan has on one other occasion resorted to reignit­ing street protests against what he referred to as the ‘old regime’ and ‘coun­ter­rev­o­lu­tion’.

Facing resis­tance from opponents in the National Assembly to move forward with snap par­lia­men­tary elections in October 2018, he mobilised sup­port­ers and paralysed the leg­isla­tive body, forcing the Armenian Repub­li­can Party to succumb.

Nate Schenkkan, from inter­na­tion­al rights group Freedom House, labelled Pashinyan’s latest steps as ‘populist’.

In a statement to Armenian news site Aysor on 20 May, the US Embassy in Armenia said that the strength­en­ing an inde­pen­dent judiciary, which includes anti-cor­rup­tion efforts and the estab­lish­ment of the rule-of-law insti­tu­tions, ‘required a long-term strategy for building trans­par­ent and account­able insti­tu­tions with deter­mi­na­tion, vigilance and gov­er­nance’.

They encour­aged Pashinyan’s gov­ern­ment ‘to pursue judicial reform in a manner com­men­su­rate with the Armenian Con­sti­tu­tion’.

Kocharyan and Nagorno-Karabakh

As a war veteran and former leader of Nagorno-Karabakh, Kocharyan is con­sid­ered to have strong ties with the political and military elite in Stepanakert.

Rifts between Pashinyan and the lead­er­ship in Stepanakert became apparent in late 2018 when Nagorno-Karabakh’s Defence Minister, Senor Hasratyan, scolded Pashinyan ally Sasun Mikaelyan for sug­gest­ing the Velvet Rev­o­lu­tion was a bigger moment for Armenians than victory with Azer­bai­jan over Nagorno-Karabakh.

Pashinyan hit back soon after, even­tu­al­ly accusing Nagorno-Karabakh’s lead­er­ship of inter­fer­ing in the ongoing election campaign in December.  

Kocharyan and his allies have been critical of Pashinyan over his insis­tence last year on including Stepanakert in peace talks with Azer­bai­jan accom­pa­nied by no direct talks between Armenia and Azer­bai­jan.

In the same August 2018 interview, Kocharyan indicated it was a mistake to disengage from the nego­ti­a­tion process, and also char­ac­terised Pashinyan and his gov­ern­ment as an inex­pe­ri­enced team coming from non-gov­ern­men­tal organ­i­sa­tions financed by George Soros, and ‘possibly’ even with Turkish and Azer­bai­jani funds.

In a speech on 20 May, Pashinyan was unprece­dent­ed in his open denounce­ment of ‘powers’ in Nagorno-Karabakh that ‘aimed to seed con­tra­dic­tions between the two sides of the [Armenian] nation’, a common reference to Armenians in Nagorno-Karabakh and Armenia.

He did not rule out that the ‘previous corrupt system’ might incite conflict with Azer­bai­jan and sur­ren­der­ing ter­ri­to­ries to them in order to blame his gov­ern­ment later.

The formerly ruling Armenian Repub­li­can Party called Pashinyan’s ‘alle­ga­tions of betrayal and con­spir­a­cy towards the gov­ern­ment of Artsakh [Nagorno-Karabakh]’: ‘extremely dangerous’.

Pashinyan accused certain people not sup­port­ing him in Nagorno-Karabakh, without iden­ti­fy­ing who, of ‘using Artsakh’s people for their narrow group interests’.

‘Overthrowing the constitutional order’

Yerevan City Court granted Robert Kocharyan bail after five-months in pre-trial detention after the inter­ven­tion of former and acting pres­i­dents of Nagorno-Karabakh.

Kocharyan was freed on 18 May as rallies of sup­port­ers and critics faced off outside the court.

Armenia’s Special Inves­tiga­tive Service charged the former president in July 2018 for breaching the con­sti­tu­tion, accusing him of giving a clan­des­tine order to ‘involve the army into a political process’ by having them assist the dispersal of 2008 anti-gov­ern­ment pro­tes­tors.

Protests erupted in February 2008 after an ally of then president Kocharyan, Serzh Sargsyan, was declared the winner in contested pres­i­den­tial elections. The oppo­si­tion led by Levon Ter-Petrosyan insisted the election results were rigged. In 10 days of protests peaking in the 1 March crackdown, eight civilians and two police officers were killed, and more than 200 people injured.

Pashinyan, an active supporter of Ter-Petrosyan, was among those impris­oned by author­i­ties in 2010 for organ­is­ing ‘violent’ rallies in 2008. He was sentenced to seven years in prison but was released in 2011 under an amnesty.

Kocharyan insisted he did not violate the con­sti­tu­tion, and that the protests involved armed violence.  

After being charged, he was remanded to two months in pre-trial custody but freed on bail less than three weeks later after an appeals court ruled his detention unlawful. His release from custody in August was also met with public outcry.

While unable to hold a press con­fer­ence due to protests, he gave an interview to Armenian TV station Yerkir Mediaannounc­ing his political comeback, and calling the gov­ern­ment under Pashinyan ‘incom­pe­tent’.

In December, he was rear­rest­ed and faced an addi­tion­al indict­ment in February on charges of accepting a ֏927 million ($3 million) bribe in May 2008.

Armenia’s Minister of Healthcare Arsen Torosyan recently refused to receive well-known Armenian American plastic surgeon and founder of ARMIN Benevolent NGO Arthur Salibian, reports President of ARMIN Benevolent NGO Lusine Avagyan.

Avagyan stated that on June 18, Salibian waited in the minister’s reception hall for nearly 40 minutes, and after the minister asked one of his employees who was waiting for him, the employee announced that the minister was very busy and had no time to receive the plastic surgeon.

Arthur Salibian is a well-known Armenian American plastic surgeon who has performed free surgeries for over 100 women suffering from breast cancer in Armenia for years.

“Today everyone knows that surgeries for people suffering from cancer are performed within the scope of a state order, but the reality is that the fact that breast cancer surgery is followed by a recovery period, that is, recovery of the breast which must be performed by allowing the breast to recover on its own, and Armenian American plastic surgeon Arthur Salibian performs this through his personal funds twice a year in Armenia.

Mr. Salibian simply wanted to meet the healthcare minister and provide him with information about the need for recovery of the breast through skin care, receive government support for implementation of the project, engage other funds and foundations through his non-governmental organization and discuss other issues,” Avagyan said.

On June 25, Armenia’s Criminal Court of Appeals ruled to arrest Armenia’s second president Robert Kocharyan. In addition, the court dismissed the decision of the Court of First Instance of General Jurisdiction to suspend the case of the March 1 events and to send the case to the Constitutional Court.

On May 18 and May 20, the Court of First Instance, presided over by Judge Davit Grigoryan, suspended Robert Kocharyan’s trial because of what it called a possible contradiction between the Armenian constitution and the coup charges brought against the former president.

Grigoryan said that the constitution gives Kocharyan immunity from prosecution. Kocharyan is being prosecuted in connection with the post-election violence of March 1, 2008, which led to the death of eight protesters and two policemen.

With the current decision of the Criminal Court of Appeals, this appeal of the Court of First Instance will be sent back from the Constitutional Court and the case will be re-examined at the Court of First Instance.

Kocharyan also appealed to the Constitutional Court on the same issue. The court has set a trial date for August 29. The court will determine whether Article 300.1 -- Overthrow of the Constitutional Order -- on which Kocharyan is being charged, is constitutional. 

Kocharyan's lawyers have repeatedly stated that Article 300.1 is unconstitutional and cannot be applied to the retired president. They argue that the crime did not exist in the law in 2008 and was only included in the law as a result of amendments to the Criminal Code in 2009. This legal dispute must be settled by the Constitutional Court. If the court finds that Article 300.1 is not applicable in the case of the March 1 events, the case will not stand as the main argument is the failure to maintain constitutional order.

Yerevan’s Court of General Jurisdiction has lifted the freeze on the pension of ex-Armenian Army General Manvel Grigoryan.

Grigoryan, a former MP and ex-head of the Yerkrapah Union, was detained on June 19, 2018, three days after employees of the National Security Service (NSS) raided his Etchmiadzin home and a summer resort in Arshaluys, uncovering a large cache of weapons and boxes of donated medical and food supplies and clothing that were destined for Armenian troops during the April 2016 “Four Day War” on the Artsakh frontline.

He was released from pre-trial detention and re-arrested on January 22, 2019.

After Grigoryan’s arrest, a freeze was placed on his assets and those of his family.

Vosgerichian Family from Lebanon Repatriates to Armenia; Must Pay $14,000 in Customs Fees Due to Legal Glitch Iskhan Vosgerichian, who moved to Armenia from Lebanon with his family in 2016, is in a bit of a quandary with customs officials. The father of two says that 4 tons of household goods he shipped by boat from Beirut are waiting in a Yerevan warehouse and that Armenian customs officials say it will cost $16,000 to clear the items. Vosgerichian, a jeweler by trade back in Lebanon but unemployed in Armenia, tells Hetq he doesn’t have the money to pay. ADVERTISING inRead invented by Teads “The items were shipped from Poti on January 15. Since then, they’ve been stored in a Shengavit warehouse. Officials say I have to pay $4 for every kilogram, or $16,000,” Vosgerichian says. Arguing that he should be given a break as a diaspora Armenian seeking to permanently resettle in Armenia, Vosgerichian wrote to the prime minister’s office. Office Chief of Staff Eduard Aghajanyan followed up on the request and got in touch with State Revenue Committee (SRC) Deputy Chairman Rafik Mashadyan. Mashadyan, in a letter to Vosgerichian, writes that although Article 249 of the Law on Customs Regulations states that those permanently resettling in Armenia can ship used personal items without paying customs fees, he is not eligible since he violated another clause of the same article stipulating that a person cannot reside for more than 184 days outside Armenia in a one- year period. Vosgerichian says he wasn’t aware of the time limit when he first arrived in Armenia in the spring of 2016. He then returned to Lebanon that August, to bring his wife and two boys. “They should tell diaspora Armenians about this when they come here. The foreign ministry or another department should hand out flyers warning them of the consequences if they violate the rules,” says a frustrated Vosgerichian, adding that this is what he told SRC officials when he met with them. P.S. Nikol Pashinyan, after being appointed prime minister, announced that his government was planning a grand repatriation program and that steps were being taken to facilitate such a venture. As the above case shows, those planning to do so are advised to read the fine print of all applicable rules and regulations.

YEREVAN, SEPTEMBER 18, ARMENPRESS. Prime Minister Nikol Pashinyan has submitted a recommendation to President Armen Sarkissian to dismiss Valery Osipyan as Police Chief of Armenia, Sarkissian’s aide Hasmik Petrosyan confirmed to ARMENPRESS.

“The order hasn’t yet been signed, but I think it will be signed today,” she said.

Osipyan was appointed Police Chief in May 2018.

The visit will begin from Los Angeles, where on Sunday, September 22nd, the PM will participate in a rally and deliver remarks at the Grand Park in central LA. PM Pashinyan will also have meetings with the authorities of California and Los Angeles, leaders of Armenian community organizations and Armenian news media representatives.

A business forum with participation of local business circles is also planned.

Then the PM will travel to San Jose’s Silicon Valley where a meeting with representatives of high-tech companies, including Armenian experts is planned.

The Armenian Prime Minister will then visit New York to participate and deliver a speech in the 74th General Assembly of the United Nations. A meeting with UN Secretary General António Guterres is planned. A number of bilateral meetings with colleagues from different countries will also take place.

PM Pashinyan will also meet with the Armenian community of New York. He will also visit an exhibition dedicated to the Velvet Revolution and the Columbia University.

Memoranda of Cooperation are expected to be signed during the USA trip.

Vanetsyan stepping down as National Security Service Director

YEREVAN, SEPTEMBER 16, ARMENPRESS. Prime Minister Nikol Pashinyan has signed a motion on dismissing Arthur Vanetsyan as Director of the National Security Service.

“I have signed the motion on dismissing the director of the national security service and the order will be signed within one or two days,” the PM said referring to the formal procedure whereby the president must approve the motion.

“This has taken place at mutual agreement with the NSS Director as a result of several discussions. We’ve discussed several options of Mr. Vanetsyan’s future activities,” the PM said.

Vanetsyan was serving as NSS Director since May 2018.

He is also the President of Armenia’s Football Federation.

The PM said Vanetsyan, as FFA president, will from now on focus on advancing the Armenian national team in the Euro 2020 qualifier.
