Armenians protest protocols
Thousands rally in the Pelanconi Park area against parts of proposed deal with Turkey.

GLENDALE — Chanting and signs filled Pelanconi Park and its surrounding streets Sunday as thousands of people gathered to rally against the protocols for new talks between Armenia and Turkey.

The talks are a part of a “road map” agreed upon last spring for normalizing diplomatic relations between Turkey and Armenia and opening the border between them. The proposed deal still must receive Parliamentary approval from both countries.

The two countries have long clashed over the mass killings of Armenians in 1915 at the hands of the Ottoman Empire. Turkey refuses to categorize the deaths as genocide and has strongly fought against any formal recognition of the massacres.

The event was organized by the Social Democrat Hunchakian Party, the Armenian Revolutionary Federation, the Armenian Democratic Liberal Party and the Unified Young Armenians. Leaders from the organizations met following the announcement of the protocols and joined together in opposing them.

On Sunday, thousands of people came from all over California as well as neighboring states. Thirty-seven buses brought people from across the Los Angeles area, while many others were forced to park blocks away. They streamed onto Grandview Avenue, which was blocked off from traffic with a police blockade.

Those in attendance expressed anger about the protocols, which would which they said were not fair to Armenia.

“Don’t give in to Turkey,” they chanted in Armenian. “Stand up and fight until the end.”

Arek Santikian, chairman of the Armenian Youth Federation’s western region, said the event’s organizers expected more than 10,000 people to attend what he emphasized was a rally for people to voice their opinions that Armenia should not agree to the protocols.

“It’s all of the Armenian community rallying together,” he said.

The most controversial facet of the protocols is the proposed formation of a historical commission to question the validity of the Armenian Genocide.

“That would make what has become a political issue into a historical issue,” Santikian said.

Glendale High School senior Salpi Topjian and Hoover High School senior Annabelle Mehrabian said they came out to the event because the Armenian Genocide is something that must not be forgotten.

Still, they said they were shocked by the number of people in attendance.

“They really want to show their support for Armenia,” Mehrabian said.

I have come up with this solution which I desperately hope someone to whom it all concerns will see. By this, I do all I can on my humble part, using the only channel available to us ordinary mortals, to save Armenia from destruction. Knowing that this will never be seen or heard, while I also have lost sleep (literally), I am preparing myself for the inevitable and horrible end of our statehood in less than a couple of decades from the moment this document of capitulation (despite a mighty victory in our baggage) is signed. Just another ancient nation being erased from the face of the earth, so what? One day, approximately eight billion years from now, the sun will cease to exist too.

That the damned names of the traitors, the midgets Serj Sarkissian and Edward Nalbandian will go down in history alongside Vassaks and Merujans of history, while the last two did have some positive traits as well, the former two, the lousy thugs at the head of today's Armenia will always be remembered as the most impotent of politicians in our history.

The end is near, may the survivor instinct of our nation be rekindled in these Sodom-Gomorrah days where Armenia has given in and has traded all our age-old traditional values to the lures and the mirage of the decadent Judeo-Saxon anti-civilization of Jewmockracy and Hebrewdom of speech...

If our lousy diplomats would make good use of this, they could also defend the territorial integrity of Armenia, signed and sealed by the only valid document, the Wilson arbitration. But alas, they can't care less.

Most importantly, the convention does not require any ratification by parliament. This along with the rest of the conditions has been added by the Turkish demand so that they can infinitely postpone the opening of the borders while they have the signed document of Armenian capitulation in their greedy pockets.

Հայաստանի եւ Թուրքիայի միջեւ հաւանական դիւանագիտական յարաբերութիւնների հաստատման վերաբերեալ քննարկումների շրջագծում մամուլում մի քանի անգամ հնչել է այն միտքը, թէ դիւանագիտական յարաբերութիւնների հաստատումը պահանջում է սահմանների ճանաչում կամ մինչեւիսկ ամրագրում է դրանք: Միանգամայն սխալ եւ միջազգային իրաւունքի մէջ հիմքեր չունեցող պնդում:

Միջազգային յարաբերութիւնների արդի փուլում դիւանագիտական յարաբերութիւնների հաստատումը կարգաւորող եւ դրանց ընթացքը կանոնակարգող փաստաթուղթը Դիւանագիտական յարաբերութիւնների վերաբերեալ Վիեննայի միջազգայնագիրն է (կոնւենցիա) (1961 թ.): Սոյն կոնւենցիայի երրորդ յօդւածը թւարկում է այն հինգ գործառոյթները, որոնք վերապահւած են դիւանագիտական առաքելութեանը: Դրանց մէջ ճանաչման, առաւել եւս սահմանների ճանաչման գործառոյթ չկայ: Նշեալ կոնւենցիայի մէջ սահման բառ ընդհանրապէս չկայ:

Քանի որ հայաստանեան հասարակական մտքի մէջ լուրջ խառանշփոթ կայ պետութիւնների կամ կառավարութիւնների ճանաչման եւ այսպէս կոչւած սահմանների ճանաչման հարցի շուրջ, նպատակայարմար եմ համարում համառօտակի անդրադառնալ դրան:

Խորքի մէջ, դիւանագիտական յարաբերութիւնների հաստատումն ու սահմանների յստակեցումը կամ ամրագրումը երկու տարբեր իրաւական գործողութիւններ են: Նոյն Թուրքիայի Հանրապետութիւնը դիւանագիտական յարաբերութիւններ հաստատելու պահին սահմանային վէճեր է ունեցել, իսկ ոմանց հետ մինչեւ հիմա էլ ունի՝ Յունաստան, Սիրիա, Իրաք եւ Իրան: Նման իրավիճակը Թուրքիային չի խանգարել եւ չի խանգարում բնականոն յարաբերութիւններ ունենալ այդ երկրների հետ:

Եթէ դիւանագիտական յարաբերութիւնների հաստատումը պահանջէր սահմանների ճանաչում, ապա այսօր աշխարհում սահմանային/տարածքային վէճ գրեթէ չպիտի լինէր: Սահմաններին վերաբերող ամենահեղինակաւոր հրատարակութեան1) տւեալներով՝ 1990-ական թւականների կէսերում աշխարհում առկայ էին տարածքային/սահմանային 314 վէճեր, որոնք վերաբերում էին 112 երկրի: Սա այն պարագայում, երբ այս երկրների ճնշող մեծամասնութեան միջեւ առկայ են դիւանագիտական յարաբերութիւններ:

Ի դէպ, նշեմ նաեւ, որ պետութիւնների ու կառավարութիւնների փոխադարձ ճանաչումն անգամ իր մէջ չունի սահմանները ճանաչելու իրաւական հետեւանք: Ըստ միջազգային հանրային իրաւունքի՝ ճանաչում նշանակում է միմիայն պետութեան կամ կառավարութեան ճանաչում (statehood or government): Սահմանների որոշման հարցը, ինչպէս նշել էի, առանձին հարց է եւ ընկած է սահմանակից երկրների բացառիկ իրաւասութեան ոլորտում2) եւ ունի այլ գործընթաց: Ըստ այդմ, սահմանները ճանաչւում են սահմանակից երկրների միջեւ կնքւած միջպետական (երկկողմ կամ բազմակողմ) համապատասխան պայմանագրով, որն անպայմանօրէն պէտք է պարունակի սահմանագծի նկարագրութիւնը կամ պէտք է յղում կատարի այդ նկարագրութիւնը պարունակող մի այլ օրինական փաստաթղթի:

Այսօր, մեր պարագայում, մենք գրեթէ ունենք երկրորդ տարբերակը, երբ Հայաստանի Հանրապետութեան եւ Թուրքիայի Հանրապետութեան միջեւ դիւանագիտական յարաբերութիւնների հաստատման մասին արձանագրութեան 5-րդ կէտով փորձ է արւում սովետա-թրքական սահմանի հայաստանեան հատւածն ամրագրել որպէս Հայաստանի Հանրապետութեան եւ Թուրքիայի Հանրապետութեան սահման: Գրում եմ գրեթէ ունենք, որովհետեւ, թէեւ նշեալ կէտով վկայակոչւում են միջազգային իրաւունքի համապատասխան պայմանագրերը, որոնք որոշել են (define) այդ սահմանը, սակայն այդպիսիք բնաւ չկան: Ուզում եմ շեշտել, որ Հայաստանի Հանրապետութեան եւ Թուրքիայի Հանրապետութեան միջեւ սահմանը որոշւել է ոչ թէ պայմանագրով, այլ՝ Իրաւարար վճռով, 22.11.1920 թ. (arbitral award):

Հայաստանի եւ Թուրքիայի ընդհանուր սահմանն իբր որոշող, այսինքն՝ սահմանի նկարագրական մասը պարունակող եւ «պայմանագիր» անուն ունեցող երեք փաստաթղթեր կան. Ալեքսանդրապոլի պայմանագիրը (03.12.1920 թ.), Մոսկւայի պայմանագիրը (16.03.1921 թ.) եւ Կարսի պայմանագիրը (13.10.1921 թ.): Թէեւ այս երեք փաստաթղթերն էլ ունեն «պայմանագիր» անւանումը, այսուհանդերձ՝ նրանցից եւ ոչ մէկը միջազգային իրաւունքի տեսանկիւնից պայմանագիր չէ: Նշեալ բոլոր պայմանագրերը կնքած կողմերից եւ ոչ մէկը կնքելու պահին չի ունեցել նման լիազօրութիւն, այսինքն՝ չի եղել միջազգայնօրէն ճանաչւած պետութեան օրինական կառավարութեան լիազօր ներկայացուցիչ: Նշեալ պայմանագրերից եւ ոչ մէկը չի կնքւել Թուրքիայի կողմից, այլ կնքւել է Թուրքիայի Ազգային մեծ ժողովի կառավարութեան կողմից, որը 1920-21 թթ. ընդամէնը ապստամբական շարժման գործադիր մարմին էր: Միջազգային իրաւունքի եւ գործող Սահմանադրութեան տեսանկիւնից՝ այդ ժամանակ երկրի սուվերէն ու օրինական իշխանութիւնը սուլթան-խալիֆն էր: Նա երկիրը լքել է միայն 1922 թ. նոյեմբերին, ի դէպ առանց գահից հրաժարւելու, իսկ Թուրքիայի Հանրապետութիւնը հռչակւել է 1923 թ. հոկտեմբերի 29-ին: Հետեւաբար՝ քեմալականների օրինական իշխանութեան մասին կարելի է խօսել միայն ամենաշուտը 1922-1923 թթ. յետոյ:

Ցանկանում եմ մի փոքր աւելի անդրադառնալ Կարսի պայմանագրին: Ես չգիտեմ, թէ արձանագրութեան մէջ յիշատակւող սահմանը որոշող համապատասխան պայմանագրեր (ուշադրութիւն դարձրէք յոգնակի թւին) ասելով՝ հայկական կողմն ի՞նչ նկատի ունի, սակայն ոչ հայկական կողմերը, շեշտում եմ կողմերը, առաջին հերթին նկատի ունեն Կարսի պայմանագիրը: Դրա մասին ես տեղեկութիւն ունեմ նաեւ ոչ-հայկական դիւանագիտական աղբիւրներից:

Կարսի պայմանագիրը երկկողմ պայմանագիր է, որը մի կողմից ստորագրւել է Թուրքիայի Ազգային մեծ ժողովի կառավարութեան, միւս կողմից՝ Հայկական ՍՍՀ, Վրացական ՍՍՀ եւ Ադրբեջանական ՍՍՀ միջեւ՝ ՌՍՖՍՀ մասնակցութեամբ (Այս վերջին ձեւակերպումը մինչեւ հիմա ինձ համար անհասկանալի է): Թրքական կողմի կարգավիճակի, աւելի ճիշտ՝ կարգավիճակի բացակայութեան մասին, արդէն խօսեցինք:

Անդրադառնանք սովետական հանրապետութիւնների, մասնաւորապէս Հայկական ՍՍՀ կարգավիճակին: Ըստ միջազգային իրաւունքի մասնագէտների3) (չշփոթել սովետական քարոզիչների հետ) սովետական հանրապետութիւնները երբեւէ չեն ունեցել միջազգային ինքնութիւն (international personality), չեն հանդիսացել միջազգային իրաւունքի սուբիեկտ, հետեւաբար՝ իրաւասու չեն եղել կնքելու միջպետական պայմանագրեր: Մասնաւորապէս, ԱՄՆ-ի սենատը 1924 թ. յունիսի 3-ին ընդունել է No 245 բանաձեւը, որում յստակօրէն նշել է, որ Հայկական պետութիւնը կործանւել է Սովետական Ռուսաստանի եւ Թուրքիայի համատեղ գործունէութեան արդիւնքում (Turkey joined with Soviet Russia in the destruction of the Armenian State)4): ԱՄՆ-ը բազմիցս պաշտօնապէս վերահաստատել է իր այս դիրքորոշումը: Եթէ 1921 թ. չի եղել հայոց պետութիւն, ինչպէ՞ս էր այն կարող պայմանագիր կնքել:

Այսպիսով՝ ակնյայտ է, որ 1921 թ. հոկտեմբերին ստորագրւած Կարսի պայմանագիրը, ինչպէս նաեւ դրան նախորդած Ալեքսանդրապոլի եւ Մոսկւայի պայմանագրերը, կնքւել են միջազգային իրաւունքի անբեկանելի հիմնարար մի շարք սկզբունքների՝ jus cogens-ների կոպիտ խախտումով: Հետեւաբար՝ կնքման պահից դրանք անվաւեր են, քանի որ Պայմանագրերի իրաւունքի մասին Վիեննայի 1969 թ. կոնւենցիայի 53-րդ յօդւածը (Vienna convention on law of treaties, Vienna, 1969), միանշանակօրէն ամրագրում է, որ «Պայմանագիրն անվաւեր է, եթէ կնքելու պահին այն հակասել է միջազգային ընդհանուր իրաւունքի որեւէ անբեկանելի հիմնադրոյթի» (այսինքն՝ jus cogens-ի) (A treaty is void, if at the time of its conclusion, it conflicts with a peremptory norm of general international law)5):

I've watched the televised speech of President Sargisian and it made a strong impression on me. His arguments as to why the border should be open make sense however there are serious flaws in his reasoning. Most of online petitions saying NO to the protocols do not reflect the true lack of enthusiasm on the part of Diaspora why the protocols should not be accepted. To put everything into perspective, an open border doesn’t mean visa-free entry. It simply means to have checkpoints and border crossing control. This fact alone is a positive development; however it has nothing to do with the rest of the content of the Protocols. Since the border even before being opened has been shut down by the Turkish side, I don't see why there must be some kind of accord between the countries to have open border. The party that shut it down has to open it! Secondly, the fear that Turkey will swallow economically Armenia is exaggerated because at present mostly Turkish goods are sold at Armenian market at ridiculous prices. Hopefully, avoiding the greedy Georgian custom officers would lower the price. Thirdly, some of our compatriots voice their concerns about the demographic situation which is complete BS, because I haven't met many Turks wishing to live in Armenia. On the other hand there might be a lot of Kurds that would try to do so, and for that matter having a border control is of utter importance.

My only objections to the Protocols are that they contain stuff that should not be there. For example having a mutual commission to study the events of 1915 has nothing to do with opening the border. Instead, the US of America and the NATO allies of Turkey should provide her with all historical records in their possession that evidence the mass killings of innocent Armenians. The recognition of Kars Treaty also should not be included in the Protocols; rather they should have agreed to form a commission examining the validity and the status of all preceding accords with regards to the borders. The agreement to cooperate on the field of preservation of historical heritage is outright ridiculous, because Turkey systematically destroyed thousands of Armenian artifacts under the guidance of the West. America and Europe falsified Armenian history and helped Turkey to erase every trace of Armenians in Western Armenia. Now they want to preserve it. In Armenian it reads: Kuna merir egur sirem!

Yes Gamavor, a very thoughtful commentary.
Sadly, all this pro and con noise is simply confusing the people rather than analyzing the so called “protocols”. It is being repeated ad nauseam, mostly by the Armenian side that there are no pre-conditions. Let’s read the articles one at a time, line by line and see.
Mainly this whole thing is about opening of the borders and establishing diplomatic relations. Yet, what does border demarcations, read “territorial integrity” applied not only to the present geography of furkey, but also to Artsakh, have to do with diplomatic relations? Are not those issues up to the future “diplomats“?. Yes, we know that the mere talk about “OPENING” infers recognition of the status quo of border demarcations, ratifying if you will the so called un ratified Kars treaty. ”historical and scientific commission”? Read discussing whether it was or was not a premeditated campaign of annihilation of the Armenian nation and wiping “ermrnistan” off the map. Which brings to mind the old adage of placing the
Cart before horse;

Once again. Let us read those “no pre-conditions” articles again and see how many hidden “sticks” there are behind that rotten “carrot”.**
In their language the carrot is known as havuj (a Persian word), “havuj akhilli amerikanlira/ carrot minded Americans” is a well known cliché. Perhaps they should amend it to read “havuj akhilli ermeniler”. Of course, if those in Yerevan don’t know that the Armenian word for carrot is stepghin , then they can have their (Arabic) “gazar/jazar” up their… noses.

Published: 25 September, 2009 On September 21, Armenia’s Independence Day, many Armenian news sites posted President Serzh Sargsyan’s statement with reference to a Russian newspaper as a source.

“I committed 21 years of my life to Artsakh land and will not allow them to be lost. Karabakh has been and will stay free. The ;occupied territories’ that Azerbaijan is demanding to concede to them are border settlements between us and them, it is our security zone. We will not give them up. Let them call us occupiers. I will not feel offended,” popular Russian daily newspaper Moscovski Komsomolets sited Sargsyan.


These words gave hope to many and raised concerns of as many, since the President’s statement did not fit into the context of his very cautious foreign policy, totally denying any kind of radicalism even in things he says.

However, news outlets kept publishing passages from his speech and nobody disclaimed them.

“We will not go to any one-sided concessions to Azerbaijan,” said Sargsyan. “They are absolutely out of question. We are ready to find a compromise with Azerbaijan with three amendments: Karabakh will never be a part of Azerbaijan again, Karabakh’s independence will be recognized on a political level and, finally, independent Karabakh has to preserve safe land communication with Yerevan. If these three conditions are met, we are ready to start a dialogue.”

So, on September 21, the Armenian authorities, on the one hand, were officially celebrating the main state holiday, and Armenian experts, on the other hand, were thrilled about the famous interview.

And only by late evening that day, when festivities were over, it became known that the Armenian president did not make any such statement, at least, not on a official level.

Nonetheless, Armenian newspapers published on September 22 placed that sensational statement on their cover pages with references to electronic media outlets. This was immediately followed by complete confusion.

It’s difficult to say unequivocally whether it was a deliberate provocation on the part of Moscovski Komsomolets or violation of “journalism ethics” took place on the part of that newspaper’s correspondent, who had, indeed, met the Armenian president, however, the mere fact of the current confusion completely reflects the state of things in the sphere of Armenian-Turkish relations and the perspectives of settling the Karabakh issue.

Official Ankara even more often and more unambiguously connects the perspective of possible reconciliation with the settlement of the Karabakh issue.

Just days ago Turkish Prime-Minister Recep Tayyip Erdogan made a statement that “Turkey will not open the Turkish-Armenian border until the Armenian-Azeri conflict is settled”.

On September 20, Turkish Foreign Minister Ahmet Davotuglu, in his turn, tied the perspectives of establishing Armenian-Turkish diplomatic relations with the Nagorno Karabakh issue.

In his interview to CNN Turk, Davotuglu stressed that “the occupation of Azeri territories by Armenia is against all international norms. Something has to be undertaken.”

The Turkish Prime-Minister and Foreign Minister are currently in New York to take part in the 64th session of the UN General Assembly.

According to Turkish mass media, they are planning to discuss the issue of normalizing relations with Armenia and officially state that bilateral relations will be normalized only in case if the co-chairs of OSCE Minsk group register a serious progress in the Karabakh settlement issue and unconditionally recognize Nagorno Karabakh as an inalienable part of Azerbaijan, and if Foreign Ministries of Armenia and Turkey sign the Protocols before October 14.

It is noteworthy, that the parliamentary hearings in Armenia scheduled for September 22 on the issue of normalization of Armenian-Turkish relations during which standpoints on the Protocols inked on August 31 would be presented, have been postponed till October 1.

What is Yerevan’s official standpoint?

In his September 22 interview to a Russian TV program “Vesti v Subotu” (News on Saturday), President Sargsyan said:

“Everybody got to know the logics laid in the basis of the current stage of settlement, that is the Madrid principles. It is about holding a referendum on defining Nagorno Karabakh’s final status, return of those territories into Azerbaijan’s control, which you called and which we and Karabakh call “security zone”, and normalizations of all our relations.”

This implies that the president confirmed once again, that Madrid principles suggest concession of 5 regions surrounding the former Autonomous Region of Nagorno Karabakh to Azerbaijan, and that by
“Nagorno Karabakh” mediators and diplomats mean not the current Republic of Nagorno Karabakh, but the former autonomous region.

I have not seen even one pre-condition by us. I'm not proponent of the Protocols to begin with. It is obvious that these documents are onesided and egoistic and as such I don't think that they are positive as a whole. The only positive thing about these protocols is that the Turkish and Armenian side have had a chat. Everything else about them is wrong. They are not positive because they don't bring change in the Armenian - Turkish relations. Not even a iota. The Turks want to have open border for economic reasons and to fulfill their obligations before Europe. Anything else is not of their concern and that is understandable.

When I said "nothing happened" this is exactly right. The border stays where it is now, exept that it will be open, the Genocide is put on "hold", same as Artzakh, and so-forth and so-forth. Small businessman will travel to Turkey, buy goods with questionable quality and make ends meet.
